When Ronald Reagan, Bush Snr and Bush jnr implemented this same program we heard crickets from clowns making noise right now in Congress.

    In my opinion this is not an option. I'd sooner take a year off of school, work two jobs to have 35k annually (if possible) and sponsor aos before I'd let my spouse be out if status for 4-5 years. At that point he'd be subject to deportation and would need a hardship waiver to return which is often difficult to get if he's from a country where it's easy to find work and be stable. Search out things like catholic charities. They may be able to help you find a co sponsor.

    Is he aware of the consequences of his staying here for years out of status and at risk of deportation, not being able to work or drive? I know the love is new but you need to look at the future. If he decides to go home later because he can't handle sitting around the house all day being bored, he will incur a ban depending on how long he was here out of status. That means no VWP (if he stays past the 90 days), no tourist visa, and added time and expense when you file for the immigrant visa.

    Then I think the best thing would be for him to return home after you are married and file for a CR-1 whilst you consider/explore your options. It just seems safer.

    This is completely false. The discount is intended for legal residents who may be discouraged by the filling fee to come forward and naturalize.
    "Currently, the naturalization fee is $680. To encourage people to begin the citizenship process, DHS would take 50 percent off the fee for the first 10,000 applicants".

    Congress can prevent all of that. All they need to do is act on immigration. The Senate did that some time ago by passing a bi-partisan bill. Boehner just needs to bring it up for a vote. It'll pass with bi-partisan support. Obama will sign it and it's all done. No need for any executive action. Problem solved. That is, if Boehner and his Republicans would actually be interested in solving problems. Of course, they're not.

    They should pay for your flight tickets. A bunch of insensitive clowns. Why can't you be scheduled for an interview here? Why put such an unnecessary financial burden on people.

    They may not even bother with removal proceedings. But if they do, it will not be until some time after the petition is adjudicated. If you don't want her deported, get her to the biometrics appointment and let her finish removing conditions. You've paid for it after all. If she wants to return to Cuba and not keep legal resident rights, then get her a ticket before the case is adjudicated.
    Given the special status given to Cubans, she may be able to change her legal resident status based on her nationality even if removal proceedings begin. But if she wants to stay, why not do so based on the ROC, its already paid for?

    Oh yes you have opened up a can of worms so I will just comment once: You are so wrong about everything you say here.
    1. I didn't judge anyone. A federal court of the United States of America already did that and he was found guilty.
    2. I would like to see ONE CASE that you could show all of us of someone being deported for getting into the wrong line. Of course the charge can be only for getting in the wrong line like you stated.
    3. We are not talking about minorities here. LPR's are not a minority group the last I checked...
    4. If ANYONE is caught with ANY AMOUNT of marijuana in a state where it is illegal it is still illegal. As a matter of fact Federal law still finds marijuana illegal in all 50 states. Doesn't matter what you think about it. It's the law.
    5. You don't want to get into the illegal drugs conversation? Isn't that what this is all about. And by the way, who ever said it was marijuana, could have been methamphetamine??? But I suppose you think that should be legal also???
    6. Alcohol has nothing do with this criminals deportation.
    7. I have no skeletons in my closet so speak for yourself. I do not use illegal drugs or alcohol in any shape or form so don't put me in with your group. I'm sure there are many other members here on VJ that also do not have any skeletons.
