US Immigration from United Kingdom

This is a long post and I appreciate for those who could read and give me some advice.

Currently, me and my finance are waiting for the K1 visa. We applied in December 2020.

However, today, I found out that you can get married on a ESTA then apply for marriage AOS. We never intended to get married here but after speaking and considering everything we realised it is taking too long to start our lives together. My Finance is from the UK and he doesn't have any obligations back home; no house, job etc. We are both 23 years old. We know it's about intent of your visit under ESTA, we never had the wrong intention. How could we prove this? We didn't make any wedding plans because the K1 visa has over a year wait so it didn't make sense.

From our understanding, we would need to a find a place that hold legal weddings then fill/send in the appropriate forms for AOS. Is this correct? I've read that under Trump, they made changes to changing status while on ESTA. My finance has been here since December 29th so just over 50 days. His return flight is on March the 19th so our initial plan was for him to leave then. Roughly 80 days total. Will this be a problem?

I know there is fees for filling for AOS around $1250 but I also saw people mention a waiver. How does this work?

How long will it take for him to receive his temporary work permit, advanced parole and then his green card? Could we travel to another state while all this is pending? We would like to move in together in a new place

Currently, he works remotely for an online teaching platform that is a US company but it's an entry level position that didn't need any checks. Will he be able to continue working?

I understand this a lot of questions but i really appreciate if any could give some answers.

Hi guys, hopefully someone with experience can give me some pointers here: I am based in Cali and applied for AOS based on a K-1 at the end of 2019 & have been waiting for a green card interview date since early last year.

In the meantime, to make ends meet I've been registered as self-employed in the UK and remotely earning money from UK-based companies into my UK bank account, and keeping up with UK taxes.

However I'm unclear about where I stand with the IRS - it seems I've been here long enough to be classed as a resident alien for tax purposes, and as I understand it, that means I should have registered as self-employed over here too at some point and started paying quarterly tax estimates? Also I've read that US tax can be offset by the UK tax I'll be paying?

I've been googling everywhere, including the IRS website, but can't seem to find clear, consistent answers about the specifics of this, or even how to start, or from what date I should have started (I'm presuming I'm a little late at this point & will face some fees - self-employment has gone on longer than anticipated as I'd hoped to find a US job by now).

Any ideas or insights are welcome.

I m a pending AOS applicant with the combo card, standing in line at the DMV and have been asked to complete an application before entering where I list all my details.

it asks:

are you a citizen? No of course

Are you a legal permanent resident? No

but then it asks:

Are you a qualified alien or non-immigrant under the Federal Immigration and Nationality Act and lawfully present in the United States?

I m not sure what the answer should be?

We have now been waiting over one year for our i130 to be adjudicated (I know many people have been waiting longer). We started in Nebraska and was transferred to California some time in April 20. It appears California is very backed up (up to 21 months). When I search the timelines there seems to be very little approvals coming out of California :(. Starting this thread for anyone who is currently in california on i130 (transferred or otherwise) to keep each other updated on progress! Note: Sorry if there is already a thread like this I could not find one.

Hi all..

I have an 11 month old whose father is a US citizen. I have applied for a Consular Report of Birth Abroad (CRBA) for my older son. However I cant book an appointment to be able to do this for my younger son. I am in the process of the spousal visa. Im just concerned that once my Visa is completed my younger son would only be able to travel on an ESTA. Is there any other way around it?

N.B. He was born after I applied for the Spousal Visa hence why he is not on the same application
