So my Fianc in the US and I in the UK have a pending Visa. I can't find a simple yes or no answer anywhere, am I able to visit him in the US in the current climate? Last time I visited him was Christmas 2019...

Hi we received a text back in March saying our case was received. I checked on the case status checker and it says they received ours in January. However we only ever got a text - never any mail or email. The text did say form I-1797 will be sent to us but we never got it. Do we need the physical noa1 mail or is just the text fine? thanks!

First of all, hello everybody, and thank you in advance for taking the time to read some exasperated ravings from the Scottish Highlands. I'm a 49-year-old Scot, and I've been in a relationship with my lovely American fiancee (who's 50 and lives in Kennewick, WA) since September 2017. We had been visiting each other regularly (mostly me visiting her in the US on an ESTA) between 2017 and 2019, culminating in our engagement on Christmas Eve 2019. Naturally, we started talking immediately about putting a plan into action in order to move in together, either with her moving to the UK, or me moving to the US, but the pandemic struck almost immediately after our engagement. As a result, like many people in this forum, I haven't even been able to visit her for almost a year and a half. We had hoped that the US travel ban would be lifted sometime this summer, but with the emergence of the Indian strain of Covid in the UK, that's looking increasingly unlikely. We've continued talking every day by video messaging, though, and we've arrived at the conclusion that it will be easier for me to get a K1 visa for the US than it will for her to emigrate to the UK (for various reasons, mostly to do with her job qualifications as a licenced clinical therapist and the fact that I don't earn enough to sponsor her for a UK spousal visa). Unfortunately, there's still so much uncertainty about the direction of the pandemic that we're in a quandry about whether or not to go ahead and petition the embassy in London right now, or wait until the travel ban is lifted. Naturally, I want to get on a plane to Seattle as soon as I'm legally able to do so, but my understanding is that once a petiton has been made for a K1 visa, it's illegal to travel on an ESTA. Our current thinking is to hold off until the fall; it will be two years next January since we've been physically in the same room, so we'll have to file for a K1 before that window expires, one way or another. She can't visit me because, like a lot of people in the US, she can't get any time off work, so I have to go to her. My question to everyone really is just: What would you do under the circumstances?

Hey Guys, Unfortunately after 8 years amazing years together with my wife (3 years married) it looks like that we're calling it quits and getting a divorce. It's pretty sudden and unexpected so not only is it pretty devastating to handle by itself, but now I'm looking over the ramifications for immigration purposes and would really love some insight. My main question here is wether or not a lawyer is needed for a divorce waiver? Specifically with the evidence I have. Whilst we were married, my partner was in full time school for almost the duration of the marriage, so she didn't have a full time job - which left me paying most of the bills. We also omitted on Health insurance + 401ks as my employer doesn't offer any perks and we were both young and healthy enough to go without them for now. So my main concern is that maybe an officer would pick up on this and be suspicious? Especially with the retirement funds. Again, we were together for 8 years and were college sweethearts so I'd like to think that it was pretty obvious that the marriage was entered in good faith, you just never know with USCIS! Hi everyone! so my friend s EAD expires in 2 weeks and she is meant to be travelling in 3 weeks (she is AOS and currently waiting for an interview for her green card). She said her lawyer told her to try and ring some immigration court and to bring all her documents when she travels to show when she re-enters. Correct me if I m wrong but I told her that she can NOT travel at all if she has an expired EAD, and I also told her that I believe she can t work either unless she has some sort of valid document - like a non-expired EAD? (She said her lawyer told her she can carry on working if she s going through the process still). just want some clarification that what I m telling her is correct and that her lawyer has really badly messed things up for her!! I also asked if her lawyer had sent off for her renewal of the EAD and she told me no! thanks in advance!!
