Filing for K-1 for 2nd time for same beneficiary

Hi all, I'm in bit of a pickle.

I (beneficiary) had my K-1 approved last year, entered the US in December, but due to a series of events, I ended up having to leave the country in January, before we could get married.

From what I could find on the internet, I would have to apply for a new K-1. Fine, I thought. I've done it once, I can do it again.

However.

I'm now back in the US on an ESTA, preparing the paperwork for the new I-129F, when I come across the following A.I. summary on Brave search:

If a U.S. citizen has previously filed Form I-129F for the same beneficiary within the last two years, the new I-129F petition may not be approved unless the U.S. Citizenship and Immigration Services (USCIS) grants a discretionary waiver under INA 214(2)(B) and (C).23

If the U.S. citizen has filed two or more I-129F forms in the fianc (e) category at any time in the past or had a prior I-129F fianc (e) petition approved within the last two years, the new I-129F petition may also not be approved unless USCIS grants a discretionary waiver.23

To file a new I-129F petition for the same beneficiary, the U.S. citizen must provide detailed information about the previous petition, including the beneficiary's A-number, full name, date of filing, and the last action taken by USCIS.2

If the previous petition was denied, the U.S. citizen can include information explaining the reasons for the denial and any new evidence that supports the current petition.2

For more information, it is advisable to consult with an immigration attorney or refer to the official USCIS instructions for Form I-129F.

What does this mean? What are my chances of being granted this waiver?

We really can't afford an immigration attorney, so we have to try to solve this issue ourselves. I don't want to go too deeply into the reasons I left, since they are personal, and I have no paperwork to justify my decision anyway.

Are my fianc and I better off marrying and applying for a CR-1, or even waiting two years to apply again? What date will they be counting from? When we sent in the previous I-129F, or from I was granted the K-1 visa? Or even from the expiry date on the visa?

Hi!

My fiance in the states just recieved a letter saying that our i129f petition has been approved! We're super stoked and have of course read the steps on what to do next probably a million times. I THINK I understand it all, but with all the nerves and excitement I was wondering if someone who's been through the whole proccess, or are further than we are, could tell us step by step what we need to next?

I understand that our case has now been sent to the NVC, and the process there will take around 2-4 weeks. After that if I understand correctly, I will recieve a letter from the U.S Embassy in Sweden with information about what to do next. Is there anything I can do to prepare for the medical exam and the interview? And what exactly do I need to bring to both of them?

It would also be nice to know a little bit more about the i134 form. Do we prepare that now? Do I need to bring it to the interview? Etc.

I would really really appreciate if someone could help clear these things out, either in the comments under this post or in DMs, to calm our nerves just a little bit! It would be nice if it's someone from Sweden, but any answers are of course super welcome!

Hi everyone! I need some advice on how you would handle this scenario:

I'm the US citizen. My wife came here from Sweden on the K1 visa and we were married Sept 22nd, 2024. We applied for AOS which was received Dec 10th 2024.

She has preexisting medical conditions that are getting worse that are causing her to worry and she wants to get tests as soon as possible. She does not have health insurance here in the US. In Sweden she gets practically free universal health care. She wants to return to Sweden ASAP to take tests and get treatments if possible.

If we apply for Advance Parole, I have read that it can take many months and there is no guaranty that it would get approved anyway. It would be difficult for her to get a letter from her doctor stating the tests are an emergency for reasons I won't discuss here.

My thoughts are to send the Advance Parole form with a letter explaining financial hardship not having health insurance in the US and wanting to seek treatment using the free universal health care in Sweden. Is there a way to expedite it? Maybe contact my Senator's office?

If Advance Parole is denied or is taking too long and she needs to go to Sweden anyway, what are the ramifications? I know the AOS would be considered abandoned, but what would happen then? Would we file a different form since we are already married to start the process over? Would it be held against her? Are there other options I'm not realizing?

Please be nice, I know I made a mistake and I am already destroyed.
But got my K1 approved and this was my timeline:
June 25, 2024 arrived in the US
July 2024 got married
August 2024 applied for AOS
February 25, 2025 left the US (abandoned my AOS). Went back to my home country.

My K1 says available until September 2024. Does that mean I did NOT overstay to qualify for a 3 year ban (less than 180 days) and I would be able to apply for a CR1 from my home country?
Or will I actually get a 3 year ban for this?
