US Immigration from Nigeria

Hello!

My husband, originally from Nigeria, was out of status and spent time in jail. He requested voluntary departure before the one-year mark, but he was not sent back to his country until after one year had passed. Our attorney has stated that we may or may not have to file a waiver since my husband did request to leave the country beforehand. Has anyone seen or been in a situation like this and a waiver was not required?

Please house, am from Nigeria and my husband is an American. We want to file for form i-130 and form i-130a online, but we don't know if it's best to do it ourselves or is it better to employ the services of an attorney? I would really appreciate if I get feedbacks.

If after an interview your spouse was denied a visa, and after a month you email the consulate and request for another follow up interview to reconsider their decision saying you have a new evidence and the immigration schedule another interview, is it a positive thing? Because I know if you are denied a visa your application is returned back to the nvc as said in their email.
