Good afternoon everyone. I would like some advice regarding a very delicate situation that's happening to me and that apparently happened to some other people. I filed for "Removal of conditions" on my 2 year Green Card back in October 2022. I filed for a waiver, having been separated from my husband since 5 months prior and in the process of completing a "Dissolution of Marriage", aka "No-fault Divorce". Unfortunately, due to various circumstances (eg. papers getting sent back from Court for corrections like 5-6 times, "ex" husband refusing to cooperate up until a couple of months ago, etc.) the RFE letter came in the mail last December and to this day we have yet not finalized our divorce. My deadline to submit the final divorce decree is March the 14th and I doubt we will have a court date before then. We are currently waiting for a hearing date and in the documents we submitted to Court, we stated that we wanted the final hearing to be the final date of our marriage, so if I understood correctly, our divorce would legally end that same day and we would have our decree? Considering a miracle is definitely not going to happen, I have a few questions that I couldn't really find an answer to on other posts: 1. What is going to happen if I do not respond to the letter? It is specified they do not allow for extensions, so that is not a viable option. Can I still respond, explaining the circumstances and ask for them to wait? Should I respond even without the decree on hand or not do it at all cause it would be pointless, since I don't have what they need? 2. Will my petition be automatically denied? How does it work? Will I get a "Notice to Appear" in front of an immigration judge and hope to have my decree by then? How long will it take for them to send me this NTA after the RFE deadline has passed or between the denial notice and removal proceedings taking place? 3. Will they ask me to just re-file the petition, including the divorce decree this time or just deny it + NTA, cause I don't meet the criteria for the waiver anymore? 4. What happens to my PR status? Will I still be able to work? Will I still be able to travel? I have a wedding to attend to in June so I will need to fly domestically to another State, but will my Green Card still be valid? I have gotten a 48 months extention letter, so as long as I carry it along with my GC, it extends its validity until October 2024, but if they send me to removal proceedings will that void both my permission to work and travel? My passport is expired, I can't use that as a backup method. I am at a loss. I don't know what to do and frankly I'm quite desperate. I'm afraid of losing everything I worked for for the past 4 years. I have a beautiful daughter with my "ex" husband that we effectively co-parent, I have a good job that is allowing me to go to college for free, I have my whole life here and this is causing me major distres cause I don't know what to expect nor what I can do to save myself from this. My hope is that by the time they even reopen my file to look at it, I will have my divorce decree and hopefully I will able to get away with the missed RFE deadline, but I know that's just wishful thinking, hence why I'm asking for advice. Hi all, Today (2/14/23), my fiancee had his interview in Napoli, Italy. Both my fiancee and I are Nigerian born. I am a US citizen and he is a permanent resident in Italy. He is currently waiting for his approval for his EU passport. However, his Nigeria passport will be expiring in December 2023, which is more than 6 months. He will be renewing his Nigeria passport tomorrow (this was the original plan). We collected and provided all the documents we need for the interview. The interviewer collected his passport and told him, his application requires administrative processing. There are no additional documentation needed from us. I read online that the processing takes up to 60 days (somewhere said it might be longer). Is this true? Has anyone experience this doing their K1 process in Italy and what was the outcome? There is an email on the paper that the interviewer circled. We do not know if the interviewer wants us to email them. The problem is we do not know what to email them since they did not ask for additional documents.

Hello everyone, I have recently learned that since I left USA in 2019 I needed to file a I-407 and as a consequence the form 8854. But actually reading carefully, I read that only if you are identified as LTR you need to file form 8854 is that correct? I became LPR in May 2016, changed country for good in November 2019 with relative change of residency also recorded in my own country. That would make 3 years of LPR, and I read to be defined as LTR you need to be LPR for 8 years. So my question is: if I just know file I-407 form so that I will not have issues in the future to travel to the USA maybe even for work, would I need to file form 8854 anyways? Thank you for anyone who will reply in advanced.

Hello everyone, So as I wrote in the title of this thread, I got a divorce and left the USA in late 2019 to return my home country. I am returning as a tourist to visit NY with my sister in April 2024, now I have no desire of course to remain, but my question rose regards of the ESTA visa since I am an Italian citizen and ESTA was already approved online, just wondering can I just go ahead and use that to enter normally the States, or do I need to bring any extra documentation because of the fact I was a permanent resident once? How does it work? Thank you to anyone who will reply.

Hello again everyone, starting from January 2024 I can file the N400. However, the main concern in requesting the US citizenship or not, is the tax implications. I basically own an apartment in my country, which was purchased by my parents in 2014 and right after was donated to me. It has a certain value (range 500k to 1M $), hence I am afraid I have to pay high taxes on it. Btw, I am not getting any income from the property. My parents live there. Question is, if I decided to become a US citizen will I have to pay taxes on it? Or, since it was purchased before US neutralization and do not get income, should I be fine? thank you !
