Late F1 visa adjudication. What to do?

In September 2020, I had an appointment for the F1 visa at the embassy and I got accepted. However, I didn't know that I had to leave Italy in the 1 month window after receiving the visa.

My classes started in January 2021, so we decided for me to send my passport via courier to the embassy in December 2020 so that the 1 month window would overlap with the start of my classes.

Unfortunately, COVID got worse and with all those flights being cancelled and stuff, I decided to not go in January and keep being a remote student for the time being. Now that everything kinda settled in (and for other personal reasons), I decided to go in the States but now there's a problem:

What do I do?

Do I just send them the passport and they give it back with the visa or do I have to re-do the appointment?

Is the start date of classes on the I-20 a problem? (In the appointment, the start date was in January 2021, but if asked I can onbtain an I-20 of any future date from my university)

If I have an updated I-20 given to me from my university, do I send it with my passport?

I tried calling already but I still have doubts regarding this situation.

If anyone is nice enough to replay to me, then thanks a lot!

Request for Further Evidence

Hi all,

I just received a RFE, due may 6th. So theres some time, but I'm both kind of annoyed and surprised AND worried lol.

What we sent with my I-751 (filed in june 2020) was 2 leases (from 2020 to 2021 of our new place) and our 2019 tax return. I didn't really add more because from my understanding (and what the lady interviewing us in 2018 said), tax return and lease should be more than enough for this petition. Regardless, my questions are as follows.

1- We are going to add the leases we had from 2018 to 2020, but before it's impossible (cuz I wasn't on the lease for reasons)... but i would imagine 2 extra years worth of lease would have a pretty decent impact no?

2- We are going to add the 2020 taxes... and send again the 2018 and 2019 taxes. We got married in 2017 (iirc right after he did taxes, or right before, so it wouldnt have mattered anyways, no?). I'm sure they have the 2018 tax return cuz i submitted it live at the interview, but again, since it was mentioned on the RFE resubmitting that year should still help?

3- My name is on the phone bill as well, but not much else... I think utilities are alongside rent and well, the internet its just at my own name. We have a shared bank account, but we use it mostly to move funds between us, not as much else, so it's dry most of the time. Not sure if it's worth including that? (though its been active since...2017 lol)

4- We have a couple of pictures taken over the years from 2/3 family trips and some selfies we take together every now and then, not sure how helpful those would be?

So yeah, i'm not quite sure what else could we submit, do y'all think 2 more years of lease and this year tax return and phone bill would be enough??? We're literally two boring ### dudes, too broke to have a mortgage or a car, not sure what else to provide :(

Not sure if I should start looking into an immigration attorney either. As i mentioned we're two broke dudes and if i could avoid that since ive done everything on my own, i'd rather to keep it that way!

Also, is it normal for the RFE to ask us to send evidence directly to someone and not one of the offices?

Au Pair J-1 Question

Hello all,

I have a question maybe some of you might be able to help me with.

If an au pair gets married before her J-1 Visa expires, should she report her status (for USCIS filing documents) as unemployed starting from the wedding date, meaning that the J-1 won't be valid anymore, or list herself as working for the au pair agency until her contract is up (would be ~1.5 months after the marriage date)?

Also, is it better to send all the USCIS documents (I-130, 130A, 131, 485, 765, 864, and 944) before or after her J-1 is set to expire?
The agency said it is okay for this person to continue working for them until her J-1 expires, but is it okay for USCIS for her to work an extra month or so after marriage?

Thank you in advance.

RFE for proof of citizenship

I just got my RFE and it s requesting proof of my US Citizenship. Some background, my father was a US military member and I was born in the Philippines. I included a color copy, front and back of my certificate of citizenship and it was identified on my cover sheet and tabbed so I was surprised to get this. Looking over the RFE s examples of proof it says the certificate of citizenship needs to be signed by the individual. I was 2 when it was issued and my father signed By Chris xxxxxx (father) and my name was printed above his signature. Do I have to sign it 36 years later (and with a different last name) for it to be accepted now? I only pulled it out last year to submit our K1 application so I didn t think anything of my dad s signature on it, since this document has gotten me passports in the past and I used it to enlist. Am I just reading into things and maybe they just misplaced my certificate copy?

Expedite EAD: how does it work?

Hi,

I was wondering how a request to expedite the EAD works. I saw some people requested it and got their EAD issued pretty quickly.

Do you really have to be on an extreme financial loss to be able to obtain it?

Or a simple employment letter can be enough?

Any experiences?

Thank you!
