Hi,

I have been a silent reader of this forum and it educated alot more about my case more than my lawyer. please provide any advice. I am currently in really bad situation, as my i-751 has been pending since feb 2021. long story short as soon my ex wife started getting better after accident things changed between us, she became voilent, vocal, aggresive,`abusive towards me and took control of all my belongings. she kicked out of the house and I was living at my employers house for who i used to work for. I have strong evidence of her cheating on me as I caught her red handed. Fast forward aug 2020 I moved out and filed for divorce in march 2021, before filling for divorce I hired a lawyer who filed i-751 abuse wavier in feb 2021. The problem with my case is I never called cops on my ex wife as i would get direct threats from her and i never went to any physc evaluation and unfortunately my lawyer never told me to do so. I recently got the notification from USCIS that my case is transferred to NBC so that interview can be scheduled. Before case transfer I got the RFE asking for medical reports, police reports, my personal statement, and pictures. apart from police report, medical report, affidavits from counselor I submitted affidavits from my ex step father in law, my ex wife's uncle, and my ex collogues who witnessed abuse marks on my body. My submission includes strong evidence of my ex wife cheating on me, affidavits testifying physical, emotional, financial abuse from my ex wife, text conversations screenshot of my ex wife threatening me, insulting me, calling me names, joint sub lease, letter from her doctor that i was with my ex wife during her hospitalization, pictures of my wounds, some pictures of us together, pictures with her family. we had a joint bank account together but my ex wife took it down in 3 weeks after opening it without my knowledge. I also submitted documentation for that. Now I am having some serious doubts on my case as the more reviews I am reading here people have tons of evidence for their case and compare to them I dont have much. should I just enhance my i-751 and change to divorce wavier instead? My lawyer is also ripping me off too as of now I have paid him around $10K but I feel like he don't know what he is doing. I dont know what will be the outcome of my case, I call USCIS and they are saying we are not able to provide any info on your case. I am really depressed!!!!! please advice and thank you!

Removal of conditions, Citizenship interview, international travel

I am in a strange predicament. We filed for my husband's removal of conditions in June 2020. Then last year in Nov 2022, we also filed the N-400. On October 11, we received the notice for an interview for both which is scheduled for Nov 15,2023. We have a trip planned to Mexico and Mexico doesn't accept the I-797 as a valid proof of residency. We were trying to get a Mexican Visitor Visa using my husband's Indian passport and all the supporting forms but the passport becomes invalid after the interview (if we take the oath the same day as it is an option). If we take the oath, we would have to apply for a US passport which definitely would not get here on time for our travel. If we delay the oath, do we get the 10 year green card pretty soon before our trip (scheduled for Dec 16,2023)? What else can we do? We really don't know what to do at this point and we really don't want to miss the trip to Mexico. Any suggestions would be appreciated please!!

Thanks for the help!

It's been really hard to understand or get any useful information from USCIS about my case status. Feeling like a lost cause, so I hope others can share their experience or insights. Really wish there was some transparency about the actual details of our case status and our place in the proverbial queue.

tldr: Question - Where is my case and what does USCIS or I need to do to move it forward? WoM is an option, but I want to exhaust all reasonable options before I spend another $5k on this process. Some details relevant to the question above:

2021:

1.1 Jan 2021: Files for Consular Processing under F2A category. F2A was current.

1.2 March 2021: I-130 was approved in March 2021.

2022:

2.1 Jan 2022: Moved case from Consular Processing to AoS by filing for I-485. Fingerprint done in Feb. F2A was current.

2023

3.1 March 2023: RFE for bonafide marriage proof from local field office (San Francisco). F2A was current.

3.2 April 2023: RFE response received. F2A retrogresses.

3.3 August 2023: F2A upgrade to IR requested. Emma live agent confirmed case is with San Francisco Field Office.

3.4 Sep 2023: Tier-2 agent returned call and confirmed case has been upgraded to IR. Expedite request declined - " case is processing as expected".

3.5 Oct 2023: Congressional Inquiry submitted. USCIS responded back with "The San Francisco Field Office has requested beneficiaries case file from the National Benefits Center." ???

It's possible that the Emma live agent misspoke or had outdated information about where my case was in Aug 2023. However, the RFE communication in March came from local field office.

1. Did the local field office transfer my case to NBC once it retrogressed in April 2023?

2. Besides WoM, is there anything else we can do to make USCIS process the file?

3. As a last resort, we will file a WoM around end of Nov / early Dec. Is it too soon?
