Do I need to bring a copy of the I797 notice to K1 visa interview?

Hi,

I am about to print out the DS-160 confirmation page and it said that passport and evidence of an approved I129-F packet is required for the interview. Am I correct to assume that means the I797 notice?

I-601 and overstay - any leniency for those who were waiting on forms?

Hi Everyone,

I've detailed the dates for my case below. I'm curious if because I was waiting on the forms for the duration of the overstay, will the USCIS consider my overstay as being less than a year in a petition? This would make a big deal for us because obviously, the overstay penalty for a year or more is 10 years and less than a year is three years (which has been completed).

Another point to make, I was in possession of a student visa that expired in July, 2018, but I don't know what the status of it was. I believe my school may have cancelled it when I finished my classes in December (I graduated early).

Dec 14, 2016 --> Completed classes at university

January 14, 2017 --> returned to Hungary to visit a family member

Jan 27, 2017 --> arrived in US on tourist visa (returned with US husband (married '15)) - planned to sell possessions from college and return home. (all questions answered truthfully at border and issued visa waiver)

Approximately February, 2017 --> discovered I am pregnant

February 13, 2017 --> Submit I-130

April 26th, 2017 --> tourist visa expires

May 15, 2017 --> walk in university graduate and receive diploma

July 19th, 2017 --> I-130 approved

Approximately July, 2017 --> I-485 submitted

Approximately December, 2017 --> I-485 rejected (accidentally used an outdated form - I filled out the I-130 and the I-485 together and waited to send the I-485 (a mistake, I know)).

Approximately January, 2018 --> prepare to send out I-485

February, 2018 --> husband received job offer abroad - we decide to not send form and move abroad.

July 15, 2018 --> leave USA

Approximately July --> notified of 10-year travel ban.

Invalidated Passport with valid visa?

Due to fingerprinting issues my father was issues a 1 year passport. The details of that are posted here: Issue with Fingerprinting - Bringing Family Members of US Citizens to America - VisaJourney

We fixed the process locally that apparently no one at the office was aware of, and proved that his condition is permanent. This enabled him to apply for a new passport to replace his 1 year passport.

The issue we now are running into is that the US Visa is already in the 1 year passport which will be invalidated. Once it is invalidated a new 10 year passport will be issued. My question is, anyone travelled with an invalidated passport that had a valid US visa by providing this old invalid and the new valid passport together? Did you run into any issues or was it accepted without any questions.

K1 visa I134 checklist for interview

Hi,

The embassy in my country sent me the visa application package for a K1 visa. I just want to confirm that I need the following documents for the I134: three years of tax returns, W2s from 2020, recent pay stubs, bank statement, official letter from the company regarding positions and salary. All three years my fiance has made enough money to be above the requirement ($30k, $31k, and now making $37k).

Is there anything else I would need for this document during my interview?

Question on I-864 Family Size

Hi,

I'm completing this form now and have a question about household size. I am sponsoring my wife and our two children are already US citizens, so our family size is 4. In the form, it's adding up five because it adds the person sponsored in this affidavit (my wife), myself, I am currently married (so one more - thus double counting my wife), and then our two children. This gives us the number 5. Can anyone point out my mistake? Thank you.
