Hi All,

First, thanks to all of you here for providing guidance on everything!

I am currently in the process to apply for a marriage based Green Card while being in the USA.

I came to the US in 2019 on a student VISA, have been studying and working on this until now. (I got my BBA, worked on OPT for roughly 10 months before going for my MBA and then working on CPT for 2.5 months and now on my OPT since August 2022).

My current OPT is valid until End of August 2025, so more than a year for sure.

I make significantly more than my wife and have been working for this company for 1.5 years.

My wife just started her Job 6 months ago and would qualify for the 125% rule, yet the years before that she would be under based on Tax Returns and Paystubs.

So my question is as I have proof of longer Employment History and with my OPT being valid until End of August 2025, would I qualify to add to the Household Income?

Her parents are cool serving as a Co-Sponsor so it's not a desperate matter, but if we can do this on our own that would be nice.

Also, if the above question is true, what would I need to prove? My employer already said they would provide a document stating their commitment if the Work Authorization pertains.

On another note, I know I can apply for a Work Authorization document during the application, can I apply for that and would that in combination with my Employer's commitment work?

I hope those questions make sense.

Was anybody else in this situation before and has advice?

I am leaning towards just involving the parents especially with the Paystub history, but looking for these answers first.

The Instructions for I864 are a little confusing when it comes to this part.

You could basically interpret it multiple ways.

Hi All,

This is a German specific question, so I hope someone is dealing with the same issue currently and has more information.

Germany passed a law allowing dual citizenship earlier this year. However, the new law won't go into effect until April or May. I have my N-400 application filled out and ready to go but am hesitant since the law hasn't gone into effect yet.

Does anyone know if the time of filing matters or if it's only important that the law is in effect by the time of naturalization? I do not want to risk losing my German citizenship, nor do I want to waste a bunch of money for the application. But I'd definitely prefer to file before rates go up in April

Hey, quick question. I couldn t really find any info on this.

We file the package per mail and want to pay the fee with a personal check. Is it possible that the father of my fianc completes the check? Or does it have to be my fianc whose information is on the check?

(N-600 for my children- waiting on their processing for more than two years by now - field office San Diego)

I am at loss. After more than two years of waiting and about 13 months exceeding regular processing times, my son just received a message from USCIS:

"We have received and approved your request for your interview to be rescheduled. Your application has been placed back in queue for interview rescheduling at a USCIS field office. Once an appointment is available, your interview will be rescheduled".

Fact is, we never asked for a rescheduling. Is this a template answer for something else? We do our regular "out of normal processing times" inquiry every three months but definitely never asked to reschedule anything. We have been waiting for an interview for so long, it is such a tease. My daughter received the notification that an interview notice had been mailed out in October but then never received an invitation. USCIS then claimed it was an error on their behalf. What do I do now? And even better, how would I be able to get in touch with USCIS about this as their service agents are not helping at all.

This is more of a rant than asking for advice or solace. I initially delayed starting the petition process to immigrate my spouse to the U.S. Once I was able to get the required documents in order to move to Germany 6 years ago, I had such a difficult adjustment with integrating myself to a new culture, language, job, etc. I delayed the process for a couple years with no real excuse.

It was the biggest move of my life, and there was so many difficult steps that maybe it was just me being afraid to start another long and tedious process again. My wife helped me get all structured and get the correct documents notarized from like 8,000 miles away. I didn't have the smoothest experience with the German Ausl nderbeh rde but with my wife's detailed preparation, it went pretty ok.

This petition process I told her that I would handle it. I would do the research and ensure I had everything correctly submitted. I wanted to pay her back for all the help she gave me, which I think now was honorable but stupid.

The VisaJourney here provided updates on when to approximately expect a response for my initial petition to the USCIS. I would say that it was totally accurate given the last suggested update I recieved from this site. So kudos to this site really... really nice and dependable.

But now I have to wait for the mail to recieve instructions on what I missed or didn't submit correctly. My account says now that the delay will take another 5 months!

I'm just so thoroughly disappointed in myself... Maybe I didn' submit enough pictures of our travels, or letters from family. I didn't include family providing a notarized letter providing their witness to the validitiy of our marriage. I thought all of the pictures, letters and cards we shared were enough.

So now I have to sit and wait and inform my wife that we have to wait. She is currently out of town taking care of her mom recovering from surgery... so I don't even want to text her about this. It will cause undo stress, so I will just wait until she gets home this weekend and inform her.

That is why I like being anonymous here and gives me a chance to rant about this situation. Thanks for reading and please make sure you have provided the initial evidence and documentation correctly. I'll provide an update here once I recieve the instructions as well as the progress of the petition.
