My wife and I just got married. We are about to send in our applications and all documents. She is almost convince that we will be denied because she will be in a few months to go to school at Carnegie Melon. Her program will last 1.5 years and after that we plan to move to a new city. I have told her it is not a rare thing to happen and I have worked with plenty of married couples that live apart due to work or school for a few years. We dated for two years prior and had to do a small elopement recently due to her family being unable to travel to the US due to Covid. To me the interviewer will probably ask more questions, but if we can prove we still see each other and are financially both tied to each other while she goes to school I think it is an issue that is easy to overcome. Has anyone had this issue before and how did you overcome it?

So we have gotten all the documents for my wife's green card. The issue is that in China where she has lived for the last 7 years, they require a passport for the criminal check but my wife lost hers in 2018 and got a new one. They will not give you a criminal check for a passport you don't have and they don't have a system where previous passports are stored. They told her that when she went today. So they can only give her a criminal check from 2018-now because she lost the her previous passport. Is this going to screw everything up?

Our response to the RFE was received on March 1st, it's been 49 days. The RFE was simply for his divorce decree, which he then got from the court and sent in a copy. I've been watching cases around our time and their approval after RFE took a lot shorter than us, like 10 - 20 days. I think they send out RFEs when other work like background check is done, right? What could be the reason for it to take this long?

Regarding showing sufficient income for support to sponsor a foreign spouse and child: On my IRS1040 I have a gross income and a taxable income (after deductions). Which of those is the important figure for showing support? If income isn't sufficient can assets (houses, businesses, etc, be used in any way to show financial support ability? My step-child has a green card and goes to college away from home, with our support. At what point does he/she not enter into the calculation for the amount required on the affidavit of support?
