This might be a silly/obvious question but I have read online (I know, not the best sources) somewhere that if you are out of status on an F1 visa without being deported and left before the expiry date of your visa you should still be fine moving forward to immigrant visa application (CR1 in my case). I wonder if that's true? I had stayed for a year but COVID played a big part in why I couldn't leave and later on I met my husband and got married immediately.

Second question is if I should file CR1 first or vice versa? I read the timeline of someone here they didn't file for i601 until their K1 was denied, and they received their K1 after waiver being approved. So I wonder if I should do the same. Thanks for everyone's reply in advance and thank you for ur help!

My wife has been here almost 8 months now. Life is good but now she wants to bring some family, mainly her daughter, son in law and their only child of 14 years old. The child has a great talent that needs to be fostered and trained or educated more might be a better way of saying it. The school here in the US agrees and is accepting her at their school and has written her an admissions letter for the school. It's a prestigious school.

So now the intensive work begins but I don't know where to start and what to do. I don't have the time to research it as I work way too many hours right now. If you have good suggestions, I would really appreciate it.

asylum visa is immigrant visa or not ?I-90 green card renewal super confused.

Hello,

I am currently filing an I-90 for green card (AS7) renewal. My spouse got the asylum status, then helped me get the asylum visa, then I entered USA as a refugee's spouse, then lived in US for one year, then applied for the green card.

Here is one question on the I-90 form:

Did you enter the U.S. on an immigrant visa?

Immigrant visas are processed and issued by U.S. consulates in foreign countries. If you have obtained a green card by applying for permanent resident status after entering the United States, you are not entering on an immigrant visa.

I don't know how to answer that question. The asylum visa of a refugee's spouse is an immigrant visa or not?. Based on the explanation by USCIS, it seems that it is not. But I'm not 100% sure. Please help me!

Does it seem like the USCIS is secretly planning to deny my I-751?

Hello Friends-

We received an RFE for our AOS from K1 visa.

The first item was regarding vaccines for the civil surgeon exam, which we understood why. We re-did the full exam to be safe.

The second item was a copy of the marriage certificate. I m not sure why they are asking for this because we provided as copy the first time. I think it might be because it was a black and white copy- so the seal may have been hard to see.

To be safe we went to the town clerk to get an official copy. I didn t realize until I got home that this copy says Certified Transcript of Marriage as opposed to the original that says certificate of marriage registration

They both contain the exact same information- and both have a seal and signature.

is anyone aware if this is acceptable?
