When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 15 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

Or, would I only have to print out page 10 to sign the form, and then after, scan page 10, and digitally (via Adobe) insert page 10 back into the entire i864 form?

1 RepliesHi guys. Our case was sent to NVC in June 17 and we submitted a public inquiry and got our NVC case number in July 14 but we have been checking the status online and our case is still At NVC. Do you know why it is taking so long for them to send the case to the local embassy? Thanks.

I m currently in the process of helping my spouse immigrate to the U.S., and we recently became documentarily qualified with the National Visa Center (NVC). However, due to extremely long wait times in our original designated country, we re considering requesting a case transfer to the U.S. Embassy in Thailand.
Has anyone here successfully transferred their immigrant visa case (specifically a spousal visa) to Thailand or another third country? I m hoping to learn from others who ve done this. A few questions I have:

How long did it take to get a new interview date after the transfer was approved?

Are there any helpful tips or things to avoid that you learned during the process?
Thank you all in advance any advice, experience, or guidance would mean a lot!

1 RepliesOk, I need help. I have been trying to get a copy of the welcome letter that is sent after the I-130 is approved. The one they did send has been misplaced. I have tried on 6 separate occasions through the inquiry portal with no help. All I get is a computer generated email stating that a copy will be sent to my email within 2 business days, same exact email just with a different name. They did attempt to call me twice about the delay and the lack of progress on our case. Unfortunately, when they did call I was at a Dr's appointment with my phone turned off and I missed them. This welcome letter is the only document stopping my wife from getting her police certificate from the Hong Kong police (she works in Hong Kong) to continue on to get her interview scheduled. Other than the inquiry portal on their website, there isn't any other way to contact them which is completely ridiculous. I don't know where else to turn to for help. It's so very frustrating.

11 RepliesMy brother (35) has a green card interview in Jakarta in a few weeks. He was in the US with a student visa but he graduated and his visa expired. He stayed in the US out of status for 2 years while waiting for the interview appointment. Now that he has received his appointment date, he has flown back to Jakarta to prepare for his interview. Is this a concern for the interview that he was out of status? He s now in Jakarta for the interview in a few weeks. He has taken the medical exam there. In the US, he lives with our mom by themselves. My mom is 72, just had knee replacements. She was a PR when she filed the application to sponsor him in 2016 but now is a citizen since 3 years ago. Any advice for a successful interview? Application submitted in 2016 when he was 26. He s not married
