Community SpotlightPSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
spicynujac posted a topic in IR-1 / CR-1 Spouse Visa Process & Procedures,
When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 14 replies
Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
Dovahkiinali0605 posted a topic in K-1 Fiance(e) Visa Process & Procedures,
I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!
narayan333 posted a topic in K-1 Fiance(e) Visa Case Filing and Progress Reports,
Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?
PeachyTocker posted a topic in K-1 Fiance(e) Visa Process & Procedures,
My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it
Mariammaria posted a topic in Adjustment of Status Case Filing and Progress Reports,
Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

US Citizen with Foreign Fiancé: When and How to Get Married?
gandalf1989 posted a topic in IR-1 / CR-1 Spouse Visa Process & Procedures,
I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

4 RepliesHi All,
I was wondering if you might have advice on our case:
We (I, PR at the time, met spouse while he was on tourist visa) filed I-130 and I-485 concurrently on January 20, 2022 (the visa bulletin was current). Our I-130 was approved in July of 2023. Since then, it shows that our case is being actively reviewed. In February 2025, I became a U.S. citizen and we uploaded a copy of my naturalization certificate and a letter informing them of my changed status to our USCIS account.
Our inquiry date has been moving steadily back, so we are still within normal processing times (Miami FO). The last time I checked, our inquiry date jumped back from July 2025 to July 2026 and we are kind of losing our minds. Our lawyer tells us we just need to wait. I saw hat we can contact our local representative to check with ICE for us, but some people say that we have to be out of normal processing time for that? Can we upload more evidence to "get someone's attention"? Anything??
Does anyone have any advice? Thank you!

12 RepliesSo my husband moved here on K1 visa. We got married within the 90 days and filed i130 and form i485 together. Got the RFE notice, and resent what they asked for. Form i130 is still pending, but form i485 to adjust status was denied. Waiting on the reason why. Has anyone else had this happen and got it approved later?
Does he have to leave the country while he has his work permit and the form i130 pending? He is from the UK btw.

2 RepliesWe entered the US with IR1 visa almost 3 months ago. Social security card arrived automatically within a week or two (funny enough with a misspelled name). We are still waiting on the green card.
I would prefer not traveling abroad without it (both due to the crazy news I've heard regarding US immigration actions but more importantly it allows certain benefits in my wife's home country (as well as third country transit benefits we will very likely need to use!). As I recall, 3-4 months was a normal processing time, pre-Trump.
Can anyone give any first hand knowledge of receiving a green card in 2025 and how long it took? There are stories of extremely long backlogs which I hope are not affecting automatic mailings of spousal green cards. We will likely still travel in the coming months either way, fingers crossed, as we want to squeeze in a trip home before the baby making begins!
I hope this estimate of 9.2 months does not apply to our situation...

Argentina medical exam process 8:57 am today

2 RepliesHi everyone,
I am sponsoring my Argentine husband from Argentina where we have lived for the past 27 years (so looking forward to joining our kids in the U.S.!)
The Embassy interview is on September 2, so we are trying to organized the medical exams in August. Can anyone tell me if the lab tests can be done on a walk-in basis? One doctor is saying that we see her in the morning, go to the lab, see her again and it's all finished in one day. This would be great since we live in Bah a Blanca. The other doctor works in the afternoon, so he is suggesting to go to the lab first, but I don't see how this would be possible without having written orders for the lab about which tests they should do.
Essentially, I am looking for people's experiences with this process in a chronological fashion, particularly for those who had to travel to Buenos Aires to do the exams.
Thanks everyone and good luck to those going through the same process!
