PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!

Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

Wrong USCIS application form filed by my lawyer!
Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

Seeking advice for Thai/US couple - What US visa path to take?
My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it
Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?

US Citizen with Foreign Fiancé: When and How to Get Married?
I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?

my wife has a memory like a sieve, we've been practicing the civics test questions and i thought she was doing OK on the old test but now with the 2025 test, she seems to have forgot the stuff she already knows!

so, suppose she fails the N400 interview on the civics, on a second test, would she have to answer 12 out of 20 randomly chosen or would they only ask the questions she failed on the first time?

if she failed on the english writing, would she get the same sentence to write next time and if she didn't know a definition on the yes/no questions, would she have to explain only the words she failed the first time?

    thanks

    I-130/I-130A Employment History question

Hello! I'm filling out our I-130A form and got a question about employment history, I can't really find the answer online, so was hoping I can get help here. I only had two jobs and I started my first job in 2022. The catch is the form is asking last 5 years of employment, so how do I put that I was unemployed before 2022? What do I put as "date from:" - 2020, my birthday (lol???)? Or it is not necessary to state that I was unemployed before that and it will be assumed? Thank you in advance!

IR1 (Mexico/Colombia) DQ July 2025: Just received "Interview Location Confirmation" email - Is scheduling imminent?

    Hi everyone,

I'm petitioning my spouse for an IR1 spousal visa. Our case was determined to be Documentarily Qualified (DQ) in July 2025.

The beneficiary is a Colombian national but is a resident of Mexico and will interview at the U.S. Consulate General in Ciudad Ju rez (CDJ).

Today (October 10, 2025), approximately 3.5 months after our DQ date, we received the following email from the NVC. I believe this notice is confirming our interview location (CDJ) since he is interviewing outside his country of nationality.

My main question for the community is this:

Given that we are an IR1 case (Immediate Relative, not preference-based) and we received this specific location confirmation email 3.5 months after our DQ date, are we considered to be at the very top of the scheduling queue for Ciudad Ju rez?

I know CDJ is high volume, but is this type of administrative email a strong indicator that the NVC is now transferring our file to the Consulate to be assigned an interview date soon?

Any recent timelines from other IR1/CR1 applicants at CDJ who were DQ'd around mid-2025 would be incredibly helpful!

    Thank you all!

    Email Received Today:

    Greetings,

In most cases, immigrant visa applicants must apply in the country where they live, with few exceptions. If an applicant lives in a country where visa services are limited or unavailable, NVC will assign the case to the designated alternate location.

Applicants living in a country different from their nationality can choose to apply in their country of residence. However, if they interview outside their country of nationality, their visa processing may be delayed.

If you would prefer to be interviewed in your country of nationality rather than your country of residence or designated processing post:

    • Contact the National Visa Center (NVC) through this Public Inquiry Form.
    • Request to transfer your case to your country of nationality.

If you have special circumstances that may require you to interview in a country other than your country of nationality, country of residence, or a designated processing post:

    • Contact the National Visa Center (NVC) through this Public Inquiry Form.
    • Explain the special circumstances in detail.

Traveling to or residing temporarily in a third country in order to apply for a U.S. visa does not constitute a special circumstance.

    Sincerely,

    National Visa Center

    U.S. Department of State

@jorgesalazar818 Welcome to fall. I hope you and yours are doing well. I wanted to check in with you to see if you have any news from the NVC? I keep all the people on my tracking list in my mind, and I send to you my best wishes. Keep me posted.
