When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 19 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

U.S. citizen petitioner here. Spouse is a Turkish national. I-130 was filed online in December 2024. No approval of anything yet, no NVC case, no DS-260, and obviously no interview. Just the initial receipt notice. I'm considering withdrawing because we ended up moving to New Zealand together instead, and plan to live here for the foreseeable future.
Will withdrawing now affect future US visa applications? Also, is it considered a " visa refusal" for immigration purposes?
If anyone has firsthand experience with withdrawing before USCIS approval, would love to hear what your confirmation looked like and whether it affected later filings.

1 RepliesHello everyone, I filed I-824 to request USCIS send my approved I-140 to NVC for visa processing, and I received the I-797 approval notice of the I-824 after one year on Aug 15 2025. But my I-140 status is still under "Approved", not yet changed to "the case was sent to DOS" after 1 month waiting. Does anyone know how long does it take for USCIS TSC send/forward my I-140 to NVC DOS. Could you guys share your timelines processed at USCIS TSC? or any advises will be much appreciated.

I am planning to hire translator and virtual lawyer. would it be a good idea to do this or do i need physical lawyer to help me during my interview please advice Thank you

4 RepliesI am in deep need of some help, hoping someone on the thread can answer my questions. We have an interview for my Iraqi fianc scheduled in early November at the Jordan (amman) embassy, but the embassy refuses to answer our questions by telephone, and they do not answer via email either. Some emails on their website no longer exist and the emails that they ve replied to are days late and one-word replies, or just re-linking the instructions.
The embassy website is filled with outdated material, and jumbles document requirements between immigrant visas and K-1. Not sure what else to do but ask here for anyone with experience with K-1 recently in Amman.
Here s the link to the website the amman embassy shared with me to understand required documentation, and here are my questions. Any insight would be very helpful.

- It mentions that documents need to be uploaded 2 weeks in advance of the interview, but the upload portal on NVC requires an invoice id number and to my knowledge that doesn t exist for K-1 visas given its technically non-immigrant. So I cant go through upload instructions.
- The website mentions filling out the DS-260 form. This is unusual because it also requires us to bring the completed DS-160 form as well, and to my knowledge DS-260 does not apply for fiance visas.
- The document list requirements mention a civil status certificate issued within 30 days of the interview. She lives in Iraq and to our knowledge we don t know of such a document besides the birth certificate which mentions here marital status. Is that what they are referring to?
- Separately, the interview confirmation page mentions that we must submit copies of our interview documents at the date and time of our interview to the nearest Aramex. How can we submit copies if we will be at the interview?
Please, any guidance would help. Don't know what to do. Thanks.

2 RepliesHas anyone had experience leaving the country between the citizenship interview and the oath ceremony? I took the citizenship exam on May 15th and am still waiting for the oath ceremony. I need to fly home for two weeks to visit my dad; he was diagnosed with cancer, and I want to see him.
