PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

We are about to submit out I-129F application (!!) and are reviewing the packet. I am wondering about the format of my foreign divorce decree and its translation.
I sent a scan of my divorce decree to a court certified translator and had it translated. The translator printed the decree double-sided as that is how the court issues it. The translation itself is one-sided and the documents are bound together with string.
I see that USCIS explicitly asks for single-sided and documents they can easily disassemble.
What should I do here? Should I disassemble it myself? Copy the bundle and submit the copies? Or send it in as is?
I would greatly appreciate some guidance here

5 RepliesI'm CR1 Beneficiary. I was wondering if there's any diabetic or hypoglycemic (who must carry glucose or snacks all times in order to avoid low blood sugar), as I read the Medical examination and interview time and the embassy can take hours, Are we allowed to bring glucose or snacks and also bring a CGM (Continuous glucose Monitor) inserted in the arm? Or it would be an issue that could affect my medical examination? I'm sure there are many diabetics on a CR1 visa process and we all know that when we crash we must eat -ingest glucose or we can pass out. No one should ever leave low blood sugar unattended.

I m hoping someone can point me to examples or sample packages for I-601 and I-212 waivers not to copy wording, but to understand structure, organization, and how successful packets are put together (cover letters, exhibit lists, evidence flow, etc.).
Brief background:

I am a U.S. citizen.

I recently completed my mom s LPR process on my own, and she was approved.

We are now filing for my dad.
My dad was denied at the U.S. Embassy in Madrid based on the following history:

In 1999, he was found to have used a false stamp in a passport, was denied entry, and returned to Ecuador.

In 2000, he reentered the U.S. without inspection.
-
He remained in the U.S. until 2008, when he left voluntarily to Spain.
-
The consulate indicated he needs I-212 and I-601 waivers.
About legal help:
I know the standard advice is get a lawyer. I ve already done multiple paid consultations ($150 $300 each) and unfortunately have not received a clear or consistent plan. Given that I successfully handled my mom s residency case myself, I plan to prepare and file these waivers on my own.My mom and I have already created a draft waiver package, and we are focused on making it as strong and well-organized as possible. We ve used AI as a tool to help with clear wording and structure, but all facts and evidence are real and properly documented.
Extreme hardship evidence we are including:

My sister was in a serious car accident in November 2024, resulting in three spinal herniations. She requires daily care and assistance, which my parents provide.

My mom is planning to begin formal studies in the U.S., which would be disrupted if she had to relocate.

We also have a 14-year-old brother currently in Spain. We are in the process of obtaining a student visa for him as a temporary solution while waiting for him to become eligible for LPR through my mom (which I understand currently takes about 2 3 years).
What I m asking for:

Where can I find real-world examples of I-601 and/or I-212 waiver packages?

Forum posts, redacted samples, attorney blog examples, nonprofit resources, anything that shows how successful packets are organized.
Again, I m not looking to copy anyone s story, just to learn from format, strategy, and presentation.
