PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

2 Replieshello! recently we got our NOA2 confirmation (yay!) for a K-1 visa, didn't receive a physical letter or anything yet.
i have a question, since recently there was a change about visa interview appointments: it's stated that the designated NIV location for interview for russians is Warsaw and Astana, and for IV is Warsaw, Almaty and Tashkent (for IR-5).
getting a schengen visa for me would be extremely hard, extremely expensive, the worst logistical nightmare ever, and i feel like i have low chances of approval. which part of this change is applicable to K visas? they are listed as a non-immigrant kind everywhere, does this mean i can ask for a transfer to Astana? if so, at which point should i submit a public inquiry? do we need to have an NVC number?

2 RepliesHi, I received my NVC case number today along with INV ID and Beneficiary ID. When I log in to CEAC website to pay the visa fee, I land on a summary information page stating that a DS160 needs to be filled out. I've already filled it out and I have the confirmation for it.
Is it possible that is not letting me pay because my case is at the NVC stage?

4 RepliesHi everyone, I'm new here. I am a USC living in Nigeria with my husband. I moved here in 2021, we met in 2022 and we wedded in August 2023. I changed my last name here in Nigeria to his but because I haven't been back to the US since we wedded, I am still recognized by my maiden name in the US. I filed for i130 with my maiden name because it says use what's on your US passport. USCIS just sent an RFE yesterday asking for evidence of a bonafide marriage. The evidences I have are our driver's license with matching addresses, bank statements with our matching addresses. Pictures from our 3 weddings (court, Catholic and Nigerian traditional) with both families and several outing pics of us out and about. For the lease issue, my Dad willed a house to me here and we both live in the house. How do I use that as part of the evidence, do I upload my Dad's Will as part of evidence and the electric bill being paid by us but it is still in my Dad's name? Please, I would really appreciate your answers

I was recommended to visit this site via a reddit post I made asking whether a K1 Visa or Spousal Visa would be best for my boyfriend and I to pursue.
I am a US Citizen and he is Nigerian. We have been in a long distance relationship now for close to a year, and we have been working on physically meeting, though faced with challenges. Firstly, due to a severe panic disorder, I have not flown anywhere before and am currently working on finding proper medical treatment for this (after long trial and error). Second, him being from Nigeria, a travel visa to come here we believe would be hard to obtain.
For background, he has no prior marriages, graduate of music, lives alone and holds a job in radio. We have an age gap of 5 years. He's spoken to my family over the course of us meeting and I've spoken with those close to him in his current region. In the beginning of the relationship I saw things like his graduates certificate and passport. No money was ever asked for, and we had a disagreement that almost ended the relationship (I know people looking for red flags often point out that fraudsters like to agree with whatever you say, butter you up, etc). I was nearly scammed several years ago by a man from India, and it taught me to look for red flags and identify suspicious behavior.We understand that there may be scrutiny due to the spotlight of fraud in the country, but nevertheless are remaining enthusiastic about our relationship and without the money to seek legal advice, are trying to do our own research and seek advice from people who have been through this process.
With the challenge regarding my health I would need to face to fly there, we considered the K1 Visa as a safer option, however many people online have said they feel it less likely to be approved for a Nigerian man, and recommend the spousal visa after marrying as a better option.
We read about the Utah proxy marriage process, but we understand we still need to be physically together prior to applying for a spousal visa.
Has anyone been through this process personally, or know someone who has, who can speak from experience, rather than opinion. Any advice is welcomed, but it would be great to talk to someone who has gone through either process and can provide more feedback. With both options being costly, we want to put our finances into the right avenue, and also not spend time on an option that might be less likely to be fruitful.

Changed jobs and GC approved before filing new Supp-J. Is it problem?
