Yes. If you are married, you can't file for a K-1. It'd be a K-3.. Before you make any decisions, research both choices thoroughly!

Love timeline:

??? 2003 -------> Started chatting regularly, became good friends

Nov 2004 -------> Fell in love

Jan 2006 -------> Met (in person) for first time

Apr 2008 -------> Wedding

Jun 2008 -------> Closed on house together

K-1 timeline:

Jun 11, 2007 -------> I-129f sent

Mar 20, 2008 -------> Visa in hand

AoS/EAD/AP timeline:

Apr 26, 2008 -------> Wedding

Apr 28, 2008 -------> Filed (forms mailed)

Apr 30, 2008 -------> Forms received by USCIS

May 06, 2008 -------> Cashed check posted to account

May 10, 2008 -------> NOA1 received for EAD, AP, and AoS

May 10, 2008 -------> Biometrics appt date received

May 28, 2008 -------> Biometrics for EAD & AoS

the US and want to marry my fiancee from Brazil , she has 2 children , her lawyer says we should marry there first . Would this hurt us applying for K-1 ?

K1 is a fiance visa. If you marry, you no longer have a fiancee. You would then file for one of the spouse visas. CR1 is my recommendation but K3 is also a possibility.

Check the time lines average wait times on this website for K3, CR1 and K1, K1 is faster path usually, just observation. :wacko:

The K-1 visa is for fiancees. If you get married, she's your wife, not a fiancee, so she's not eligible for a K-1. You'd need to pursue a spousal visa.

Yes. He can't be much of a lawyer if that is the sort of advice he has to offer. There are a number of horror stories on the forums about bad lawyers.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

Thanks guys 0 I am filing K-1 but panicking because of my hastily booked wedding that is in Feb and can't be changed!! We are going to make it a non-legal ceremony then have our legal wedding on entry into the US on a K-1 but having this info is really helpful for if any *cough* nightmares occur... heaven forbid :/
