Question about evidence for AOS interview

Hi,

We have not got a date for our interview yet but our lawyer sent us a list of documents we will need to start collecting for the interview.

I wanted to ask people here who have already had their AOS interviews how they went about getting this piece of evidence:

1. AFFIDAVITS: A (notarized statement) from at least three people attesting to your current marital relationship. These affidavits should state the their name, address, status in the United States, relationship to you and/or your spouse, and how he/she is knowledgeable of said facts. At least one of these affidavits should be from a neighbor. The affidavits should be detailed and informative, not general statements.

Any advice would be appreciated, thanks :)

I just sent in the paperwork for AOS but wanted to comment. It seems pretty awkward to ask a neighbor to do this. I'm cordial with my neighbors but not looking forward to saying "Hey, want to go with me to a notary so that I can prove that my marriage is real?" Give me a break.... :/

I was planning on getting my mother and sister to write this affidavit. I wasn't aware of the "neighbor" requirement.

Didn't know affidavits were required now for AOS.

We didn't submit any and didn't have any problems.

I-751 [removing conditions] recommends have a couple tho.

Guess if you are short on having enough evidence of a bonafide marriage they may help.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

The Affidavits are not required, they are just another piece of proof that one can get or not (especially those who don't have much paperwork with both names on it). We had two affidavits, one from the maintenance guy in our apartment complex (he is from the same state in India as my husband is) and the other from one of my co-workers, who was at our marriage. They were not interested in composing it themselves so I just got their info, reconfirmed what I would write, and I typed it up so they just had to sign and notarize it. :whistle:

Those affidavits were the worst part of gathering everything to file. God bless my friends and family, but they wrote some silly stuff. I had to send them back and forth to the lawyer then track everyone down and get them to the notary.

Don't even get me started on pictures. We HATE pictures. We DETEST them. We would never take a picture of ourselves for any reason, until now. It's torture.

04-02-2008 FINALLY our appointment and APPROVED ON THE SPOT THANK YOU GOD/GODDESS/EVERYONE

04-11-2008 Green Card arrives PHEW

Haha we are allergic to photos too. :yes: I was paranoid about us needing photos so twice I had to beg and plead hubby and we had someone in the store take our photo (while shopping), just for the AOS interview. They came out blurry though. And for the courthouse wedding, my boss at work sent our photographer (I work in the graphics dept), I tried to say no no not necessary but no one listened. Got some decent photos only due to that. Turned out no one asked for the photos at the interview. :no:

I wasn't even aware that affidavats were an option for AOS. We certainly provided letter for lifting conditions :unsure:

So I guess if we just get my mother-in-law and my friend/ my H's coworker (who is also our neighbour, hehe) to do it then it's ok? I'm already anticipating that this will be very not fun :no: but nevermind :)

P.S. This may be a stupid question, but would we use the lawyer as our notary (I'm not sure how these things work here in the States) or would I have to find a notary myself?

If your lawyer is an official notary, he/she can do it. Otherwise, people who do it are all over the place, most charge $10 a page. I got it done at a local postal annex shop, my co-worker got it done at her credit union for free.

The affidavits were not on the list of required items for our AOS Interview and they were not asked for during the interview so I can't help. I would really hate to start asking neighbors (who I don't even speak to or co-workers that I don't share my personal life with) for affidavits. Darn, the majority of my family hasn't yet met my husband as he's only been in the country for two months.

P.S. This may be a stupid question, but would we use the lawyer as our notary (I'm not sure how these things work here in the States) or would I have to find a notary myself?

You can find a notary at almost any bank in the US (any main branch that is). I think each state has different rules on how much a notary can charge, but it is very low. In Illinois they can only charge $1 to sign :)

In other countries the term notary means more of what the responsibilites are associated with an attorney in the US. So don't let the US attorney's fool you into taking more money than they should.
