how do people fight denials, and how long do they take? is it better to apply for k1 again or k3...is there any shorter way for this? :crying:

Before you can do anything you have to know why you were denied. Post the details as soon as you know and I am sure you will get lots of advice from the people here.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

Agreed.

Just be patient Laura and wait to see if you were actually denied. You may not be. Once you get the information you need, if there is a denial, take some time with your fiance to regroup, comfort each other and then move on to plan B.

yes, i will wait, but as you can see i am pretty desperate. my fiance has a job a house and a life, but i made my life around him , i quit school because i was planning to do it in the us and now i am at ground zero. i am scared that there will always be something they won't like and that i will keep on seeing denials and denials...i hate having to talk to him on computer every day and just imagining how our life could be together... thank you again for info, i will post what we got and i am sure the best advice will come from this site....

Sweetie, I totally understand where you are coming from, believe me. The only advice I can give you is, stand on your own too. Occupy your time while you are away from him by working, saving money, going out with friends. etc. I know you want to build your life around him but you must have something of your own too. It will make it a bit easier being so far.

I'm tired of the computer too, I'm tired of having to see Nick through a web cam, I'm tired of not just sitting with him in a room, watching tv and snuggling on the couch and we haven't even filed yet, we have a long way to go.

You will be with him. If this is a denial, you guys will find an alternative, work through it and you'll be ok.

I wish you all the luck in the world.

Laura, it really sounds as though you have a straightforward case - if that's really the situation, then whatever went wrong won't be too hard to correct.

Keep us posted, and I know everyone here will help as best they can.

If you look at one of the OP's numerous other posts about this situation you'd see that USCIS case status now states online that they have sent her a decision regarding her petition. I have seen another member with the same online notice and it turned out to be a denial. But I agree that before she can take action for an appeal or a new petition, she must wait for the reason for the denial.

Laura - did you ever get notice that the RFE was received and that case processing was resumed? If not, they mightn't have gotten your RFE and that would be the reason for denial. Just a thought!

Remember - keep your head about you. Panicking will not help!

yes, our case status resumed on nov 6th and we had two touches and then this...we will se what this is. maybe we did not send the rfe right. we will see, i will keep everyone posted. and thank you again for all your posts :)

I know you're in a tough spot but as others have said, there's not much anybody can help you with until you have the reason for the denial.

However, you don't actually "fight" a petition denial. You just make sure you meet the requirements, get your papers in order and file again. I do suggest you get your fiance directly involved here, because he's the one that files the petition and needs the help directly. Often things get lost in translation when passed through another person.

Facts are cheap...knowing how to use them is precious...

you mean get him to read what all of you are telling me or should he do this himself without the help of a lawyer? i am not sure he will be able to do it himself because he is way too busy.and i am the one who forward him the answers to all my topics here.. but he is very involved and upset about our outcome, but he says to have patience and faith and we will succeed :)

If he's reading the responses, that's good enough. However, my initial assessment is that the lawyer is the source of the problem, in that he misinterpreted the RFE and failed to respond appropriately. Maybe he'll get it right the second time.

If he's reading the responses, that's good enough. However, my initial assessment is that the lawyer is the source of the problem, in that he misinterpreted the RFE and failed to respond appropriately. Maybe he'll get it right the second time.

yeah...i think i should not fire the lawyer and make her get it right this time...even though she probably misinterpreted ..she is still the one who knows our paperwork and who will know where she screwed up ...what do you think? should i give the case to a new lawyer or let her do it? frankly, i am in no state of mind to have a logical and objective thinking...
