I'm the mother of a daughter that has been fighting the Embassy in India. She has been trying for 3 yrs to get her husband here.

They met on the internet 4 yrs ago.

She went to India 2 yrs ago to meet him and get engaged.

She then came back and filed for a fiance visa. She went through all the expense and time to do this. After 10 months the USA ok'd it and sent it to the Embassy in India. After an interview was done 2 months later.. it was denied for lack of proof of a true relationship.

So, she went back this year in March. She married him and had to leave him 4 weeks later to come back to the states.

She then filed for spousal visa. The USA ok'd it again in September of this year. The papers were sent to India again.

My daughter left for India to be there when her husband had his interview.

He had his interview yesterday. They denied him again saying he would get his visa but they had to do a security check first.

We are all thinging they are just giving my daughter and her husband the run around.

Does anyone know of anything that would make a difference.

My daughter is still in India and will be there till Nov.26th.

Please help.

He wasn't denied, they are just further investigating.

Be worried if they said denied.

I'm sorry this is such a long process for your daughter.

All I can really say is you're gonna have to hire an immigration lawyer for your case. Since your initial fiance visa was denied, you were already "red flagged", since you did not satisfy the requirements to show proof that you two were in a true relationship. So currently, this is what they are after, in their eyes (consulate) you couldnt prove that you were in a true relationship (and thats what triggered the security alert or red flag) even if you filed for spousal visa. The consulate feels you are hiding something since you could not prove your relationship and just married instead just so you can avoid the problem (and you gave them a run around).

What you are describing is very common, unfortunately. Hopefully, after the security checks are done, your daughter will be able to be reunited with her husband in the U.S.

hello there, i was reading your story here.....it sounds like they will do a security check....i had this done with my fiance...we waited one week and then they called him back and they granted him his visa that same day....ask her to wait one week and see if they contact him again.....good luck to you.......

That's so sad, I'm so sorry for your daughter and all she has been through. :crying: Can't they just see how loyal she has been after all this time? :protest:

Anyway, I'm not sure what you can do at this point. You probably just have to wait out the security check. Praying for a positive outcome! (F)

May not seem "fair" but:

Embassies do have reasons for refusing some peeps and OKing others.

After going thru the process a couple times I now can see why they denied us the first time around!

They were correct in denying us as we didn't show enuf evidence of having a bonafide relationship.

Second time was a completely different story as we hit them with "both barrells".

All I can really say is you're gonna have to hire an immigration lawyer for your case. The consulate feels you are hiding something since you could not prove your relationship and just married instead just so you can avoid the problem (and you gave them a run around).

I'd be really surprised if there was any connection between the K1 denial for lack of bona fides and the additional security check. It's a security check, not a bona fide relationship check.

I'd just wait it out with positive expectations.
