hi socalwaiter,

you mean I will get these forms from American Embassy?

The NVC are sending my I-129F to the Embassy. And which form of the Affidavit of Support is required for the I-129F?

Or need I have both of them (I-864 and I-134) for the Embassy? (My I-130 is approved too, but they are sending only I-129F)

I am a little confused why they will send these forms to me?Actually my wife should fill out this form for me.

my another question is: what should I do, if her salary is very low for supporting me because we have two kids too.?

Or is it enough that she fills out these forms and send them to me?

Hi Amoro,

1. Please fill in your timeline :)

2. For a K3, you need the I-134. You will need the I-864 later for adjustment of status.

3. Have you checked the poverty guidelines regarding the level of income you must have in order to support a family of your size? If you guys don't make as much as required, you can use an american co-sponsor. Remember, assets can be included to income (you must have five times the amount needed.. i.e. if you need 1,000 to meet the guidelines, you must have 5,000 in assets). Assets can only be included if you can show that liquidating them (such as a house) can be done within a year and will not cause a burden. The Affidavit of Support is crucial in obtaining the visa. You must must must meet the minimum guidelines.

An important question, what can I do because of my work permit when I am with K3 in the US 1) should I apply for a

Employment Authorization (I-765, it will take 3 month) or will I get my Green Card within the 3 months?

Thank you for filling in your timeline, that helps others in their journeys and it helps others help you too.

The embassy needs the Affidavit of Support form I-134 at the interview. You need the Affidavit of Support form I-864 when you are in America and are applying for your Adjustment of Status.

You will not have a work permit until you apply for your Employment Authorization (although people have said that you could get a temporary EAD Stamp (Employment Authorization Document) if you enter thru JFK airport that will be good for 90 days. You supposedly will get the EAD you apply for (with the I-765) in three months. The green card will not be that fast.

Here is the 2008 Federal Poverty Guidelines that the embassy will use to see if the USC has enough money to be eligible to sponsor a foreign spouse:

For Each Additional Person, add $4,500 $5,625 $5,175

For example: I have three children and I live in Pennsylvania. Therefore I look at the row that counts 5 in the household (me, my husband, the 3 kids = 5) and I look in the column for 48 Contiguous States (which PA is one). I have to have an annual income of $31,000 in order to sponsor my husband.

I will fill out the I-134 and attach supporting documents (my pay stubs, a letter from my employer, my court order for child support etc., you attach what applies to you) and my husband will take all of that to his interview in Lagos, Nigeria.

When my husband comes here, I will apply to adjust his status as well as apply for his Employment Authorization. During the Adjustment of Status phase, I will be required to fill out the I-864 Affidavit of Support form and submit it with all supporting evidence again. At both times, I have to prove I have an income of $31,000. If my annual income was $26,000 (for example) I would have to show them that I have 5 times $5,000 in assets ($25,000) to make up the difference The assets have to be able to be liquidated w/in a year w/out causing a burden. If I had $25,000 in the bank that would be perfect, or if I had a property I could sell that would be assessed for at least that amount, that would work too.

If I did not make $30,000 and I didn't have any assets I could use, I would have to have a friend or family member agree to co-sponsor him. They too would have to fill out forms although I don't know what they are. I'm not using a co-sponsor so I never really learned what is needed. If your wife needs a co-sponsor the guides can help her with that.

The I-134 and the I-864 use the same standards (the same requirements) This is what the I-864 form instructions says:

What are the income requirements?

To qualify as a sponsor, you must demonstrate that your income is at least 125 percent of the current Federal poverty guideline for your household size. The Federal poverty line, for purposes of this form, is updated annually and can be found on Form I-864P, Poverty Guidelines.

I could not understand anything with the forms I-134 and I-864, because we are trying to find a cosponsor for me.

In Form 1-134, there is no field for a cosponsor, but in the I-864, there is a field, which a cosponsor can fill out.

Dose anybody have the same problem with the cosponsor form (for I-134)?
