Maybe this has been addressed before, and I just haven't found it..............

I am trying to get my new wife, (on K-1 Visa), a driver license in Tennessee. They will give her a license if she is only in a "Legal Permanent Status". Well, we don't have anything to prove she is here legally after her 90 days is up. Do we?? We have got married and will be filing the AOS next week. But after you file the AOS, and the 90 day visa expires, how does she prove that she is still here legally? Tennessee will only give a Driver license that is valid for the length of the Visa, (i.e. 6 month tourist visa, student visa, etc.)

Any suggestions of what I should do?? I mean even though her K-1 expires she is still legal. The customs official at the POE wrote 11/11/07 on her K-1 as the day the K-1 expires. It would be stupid for her to get a license valid for only a month.

States are funny that way... MN will accept approved EAD or AP as proof in lieu of greencard... Some will accept your NOA1 from AOS as proof... it varies wildly from state to state

Once you have the receipt from filing the NOA, many states will allow you to get either a regular driver's license or a driver's license that is good for longer than the month left on the I-94 or what have you. C. received a driver's license that's good for six years with the NOA. But it depends on the state (and sometimes the particular DMV office.)

I live in Middle TN. My husband was only able to get a Certificate For Driving while he was in K1 status. It allowed him to drive but was not a Valid ID. (this was back in Feb of this year). Expiration I believe was 2 or 3 years. We just got his regular drivers license a few weeks ago after he got his Greencard. If you go to the TN DMV website it lists all requirements. You will need to show 2 proofs of residency in her name (utility bills/bank statement, etc), SS card, passport. see link http://www.state.tn.us/safety/driverlicense/dlproof.htm . So right now she is just eligible for Certificate For Driving. But at least she can drive. (Every state is different on Drivers license requirements)

Again DMV is a State's Rights thing, driving privileges are issued by the states, not the federal government, and so the standards for eligibility vary greatly.

NY has just changed theire rules allowing anyone with valid verifiable ID to apply for a driver's license, NO EAD, Green-Card, or Valid I-94 required.

but to answer your other question, to prove she is here legally she should carry a copy of the expired K-1 to show that she entered legally and a copy of the marriage cert to show that you fufilled the terms of the K-1. if you have a copy of the NOA for the I-485, she should carry that s it will state that she is pending.
