AUGUST I-129F FILERS UNDER CSC

The purpose in creating this thread is two-fold; it would be good to keep a track on each other's progress but also because there is seemingly an issue with some applications received by California Service Center in mid-August, it seems necessary to maintain contact with people who are concerned about the filing of their petitions. I noticed a few people have posted concerns on another thread but it might be useful to keep things all in one place.

Here's my story: I mailed my K1 Visa application to CSC on 27th July but it was not received until 15th August, therefore I am technically an August Filer (although I would love to say I am a July filer, ho-hum :whistle: )

Anyway, I have yet to receive an NOA1 or have my check cashed and under some good advice from a member on the July Filer thread I did a timeline search to see what the status is for NOA1 issuing for August.

What I noticed was very interesting; There is a range of 11 applications sent between the 8th August and the 24th August and not one of us have received NOA1's as yet. There are NOA1's for all other applications sent in August before the 8th and for most after the 25th.

My fiance and I have been wondering whether to resubmit our petition (in our case, this would mean resubmitting with the new fee, which I'm less worried about than the actual time lost) but, it looks to me like CSC have a wad of petitions they are unaware of. This is not one or two applications we are talking about - this is a whole set of applications received between two specific dates (and these are just 11 we know about).

Those of you planning on resubmitting might want to hold off for a while - not least because USCIS have said they will honour the received date as the start date for queuing purposes.

I hope this information is of use to some of you. Those of you who have received NOA1s: congratulations and good luck! Let's keep in touch with one another on our progress.

Thank you Tracy, this is helpful.

I think the applications CSC received between Aug 8 and 24 are all in the same box(es) and for some reason they did not touch them yet.

I think we better not to re-file yet, however I have to say that I cannot help myself worrying about the situation since USCIS announced on their website CSC has completed data entry and issued receipt notices for applications and petitions received before Sep 6th now.

I guess we should just be patient to see how thing goes. I know it is very stressful but I think being patient is the best way for now.

I filed on August 28th and no NOA1 so far or check cashed. It sucks

Yep, not knowing what is happening is frustrating. Especially when CSC say they have finished processing late August applications now. I have seen a few people who filed after the 25th get NOA1's. I think you'll be ok :)

Good luck and keep us posted. Every time someone hears something it gives me hope that they might be processing mine soon!

Hi Tracy,

We're in the same boat - I mailed our I-129F packet on 8/10 to CSC, received on 8/13. No check cashed, no NOA1. What's especially confusing is this:

USCIS' weekly update on where they're at in issuing NOA1s. According to the 9/14 update, they are processing I-130s received 8/8/07, but for "all other forms" they've completed data entry and issued receipt notices for applications and petitions received on or before 9/6/07. If they are lumping 129Fs in with the 130s, then we don't have anything to worry about yet. But if we read this update literally, something's gone amiss.

Any thoughts?

USCIS Application and Receipting Update

U.S. Citizenship and Immigration Services (USCIS) advises customers that, due to a tremendous increase in the number of applications filed, processing of fee payments and entry of cases into our tracking system is behind schedule. As a result, applicants can expect notices of receipt to be delayed. USCIS is working hard to deal with the increased volume.

Delay in fee processing and data entry will not affect an applicant's Change of Status or Extension of Stay eligibility if all other eligibility requiements are met. USCIS continues to process Premium Processing Service requests within 15 days.

USCIS will honor the actual date that an application was received in our mailroom; this date will be indicated on the receipt (in the Received Date box) when Form I-797, Notice of Action, is mailed. Until this situation is resolved, USCIS will provide these weekly updates on progress in issuing receipt notices to our customers. We appreciate your understanding.

My fiancee and I were just talking about this issue. We think USCIS are counting the I-129's as I-130's since it is a similar type of application. If we think that way, it would explain a lot. I believe we will hear from them shortly.

whats really going on?it would be nice if they just inform us if they lost it or what,since we all got a receipt or a letter back that they received it.

Hi, thanks for your post. I'm sorry that there are others who are having this worry over their petitions but also glad that I am not alone here.

I think, like buckeyes that perhaps the I-129F applications are lumped in with the I-130 data. I have posted a couple of questions about how whether the I-129F is classed as 'all other forms' or the I-130 on two other VJ threads but have no clarification as to whether this is the case. It does seem likely though. I will update here if anyone responds to that question with a firm answer.

If we are looking at 8/8/07 as being a starting point it still doesn't explain why I-129F applications received at CSC after the 25th August have already received NOA1's. Still, those of us who haven't heard anything appear to belong to a specific time frame for receipt at CSC and therefore I can only assume that we're all sitting in a box together at CSC.

If that is the case, and our received date is honoured then we'll be back to where we thought we'd be soon enough. *fingers crossed*

The receipt is merely proof that US Mail delivered it. I actually didn't even receive the return receipt, but I do have a tracking number and proof online that it was delivered. I doubt CSC will be able to inform us if they lost our applications, but, let's hope it doesn't come to this, we all have proof that our packets were delivered.

I really don't want us to be in a position where we have to prove we actually sent in applications and have to face difficulties in getting our applications backdated. That would really suck at this stage.

I will keep my fingers crossed that we all get processed soon. Please let me know if any of you receive an update. Best of luck!

I'm in the same boat as well. I sent my the I-129F package on August 20 by certified mail. It was delivered on August 22. Still no NOA1 or have they cashed my check.

Hi - I am an AOS filer (received K1 in July) and we sent to the Chicago lockbox but should have then been sent to CSC. Application received on Aug and same thing - nothing. I have been hearing of people who filed after August 20 now receiving notices quickly again and was wondering the same thing - were there applications from our dates misplaced? Anyone from between Aug 7-Aug17 heard anything?

Hi guys! i feel so blessed because my fiance mailed the I-129F packet sept 5, and he received the NOA1 sept 10. We filed it at the California Service Center. I don't know though whether the check has been encashed.

We also have the proof that it was delivered. So I am sure they have our packages somewhere in their office unless they accidentaly trashed them! Oh that sounds like a really bad joke though...

So babblesgirl, are you gonna make any moves or you will wait for more while? I think we will need to wait for 90days to re-file it anyways.
