New Jersey Attorney General: Cops must ask suspects for immigration status effective immediately

Attorney General Anne Milgram today ordered all local police officers in New Jersey to inquire about the immigration status of suspects charged with serious crimes, and to notify federal immigration authorities if there is reason to believe the suspect is in the country illegally.

The requirements, which go into effect immediately, apply to suspects arrested for specific indictable offenses and for driving while intoxicated, Milgram said. If the suspect is unable to prove he or she is legally in the United States, the police officer is required to notify Immigrations and Customs Enforcement, she said. The policy also specifies that prosecutors and courts be notified.

Local officers cannot inquire about the immigration status of crime victims, witnesses to crimes or persons requesting police assistance, she said.

"The overriding mission of law enforcement officers in this state is to enforce the state's criminal laws and to protect the community that they serve," Milgram said. "This requires the cooperation of, and positive relationships with, all members of the community. Public safety suffers if individuals believe they cannot come forward to report a crime or cooperate with law enforcement."

Hmm, I live in NJ. As a U.S. Citizen by birth with a non white exterior skin color, I guess I will need to carry my passport with me just in case.

They are only asking if someone is charged with a serious crime. In reality it should be asked if someone is charged with any crime.

Not understanding English is usually a good sign to whether an officer should ask of someone's immigration status.

I guess next time there's a shooting in Newark involving someone with a dodgy immigration history, people can blame ICE for failing to follow up on a tip rather than the local PD?

I trust noone missed the part where you have to have already committed the crime for your immigration status to be called into question...?

I trust noone missed the part where you have to have already committed the crime for your immigration status to be called into question...?

Indeed. Hasn't this already been policy, to check the immigration status of suspects in serious crimes? (If not, it seems to magically appear on the news all the time...)

So really this is just putting a new spin on 'business as usual'.

Yeah, this is pretty much an announcement of the status quo. "Don't worry, nervous rich people. We ask if the criminals are here illegally. Don't worry, victims. We won't arrest you for being illegal if you call us because you saw a shooting or your husband was beating your kid."

yes, i think it was always the case..with convicted felonys ..being deported after their sentence is completed..saw it many time when i worked in corrections

What does a person's economic status have to do with whether they should be concerned about crime by illegals, or crime in general? Do you have an issue with people who make more than you?
