Hello!

 

We are in the process of filing/applying for adjustment of status using form i485. During the process, it says we need to complete a partial i693 because a full panel physician medical examination was already done in the home country of my fiancé (now husband). The partial i693 has a vaccine worksheet part 10 that needs to be completed and signed in part 7 by a Civil Surgeon. We went to one today to finish this process. 

 

I was under the impression that the Civil Surgeon/their office would sign the paperwork and stamp it then put it in a sealed envelope and hand it to me the same day. But this office is saying that they are going to send it to the State dept to have it officially stamped, sorted and sealed, then mailed back to Civil Surgeon's office and then that is given to us in a sealed envelope. They insist its a 2 week process.

 

Is this how it works for everyone else too?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If your Overseas Medical in preparation for the K-1 interview at the embassy was less than 1 year prior to you filing the I-485, then you don't need to do an I-693. I would just include a copy of your DS-3025 with the I-485 to remind them you are a K-1 applicant and you are exempt from the I-693 requirement. Just make sure you select the correct filing category on the I-485 for a K-1 applicant who got married to their petitioner within the 90 days which is:

Person admitted to the United States as a fiancé(e) or child of a fiancé(e) of a U.S. citizen (K-1/K-2 Nonimmigrant)

I am hearing conflicting information about it. I am also hearing that the new polio vaccine is required as part of the vaccine requirements. My husband didn't get the polio vaccine during his medical exam done by the panel physician. They marked the polio vaccine as "not age appropriate" but the civil surgeon is saying that the new polio vaccine requirement is ok for all ages so it's required, which means my husband would need to get it and then that would mean he needs a partial i-693 completed (parts 1-5, 7, and 10). 

 

But yes,  we still have the DS-3025 copy but the polio vaccine says not age appropriate blanket waiver.

The polio vaccine is now required and "Not Age Appropriate" blanket waivers are no longer accepted for medical exams done after 5/1/2024. Your husband will have to get the Polio vaccine done here. This is not a reason to delay your filing of the AOS as the polio vaccine question does not come up until the interview

I understand you're not my immigration attorney...

but would you say I should just file with just the DS3025 copy with the AOS, even though they might send an RFE for the polio vaccine? My husband got the polio vaccine yesterday while at the civil surgeon office, is it ok to just include the polio vaccine documentation (not on DS 3025) in there instead of waiting for the i-693 for 2 weeks to come back in their sealed envelope? They told me i have to pick up the sealed envelope in about 2 weeks because the state needs to do the sorting/sealing...

In my humble opinion, if he already got the polio vaccine, already went to the civil surgeon to have the vaccine assessment part of the I-693 done and you are just waiting for the sealed envelope and they said you'll have it in 2 weeks, then I would wait for the report from the civil surgeon and send it with the I-485. USCIS is not giving out RFEs for the missing polio vaccine until you get to the interview stage. If you don't have the vaccine assessment done with it added by that time they give an RFE after the interview. However, waiting the extra two weeks now and sending it with the I-485 will save you from having to deal with it at the interview. So to sum up, if I were in your position I would wait for the sealed envelope before filing and send it in with the I-485. Also, still send a copy of the DS-3025 because that will remind them to look for the full overseas medical report to put with your file.

No, the way they're planning to do it isn't right - nothing gets sent back to Department of State for processing, you're dealing with USCIS only now. Like someone said, if you're in the one year period of completing overseas medical and your form with vaccines is marked as complete, you don't need to do I-693.

Yes they actually do need to complete the vaccine assessment part of the I-693 because her husband is missing the Polio Vaccine and it is now required. They marked his DS-3025 with a blanket waiver as "Not Age Appropriate" which is no longer accepted for medical exams done after 5/1/2024. They need the vaccine assessment part of the I-693 done to give to USCIS to properly document that they now received the Polio Vaccine.

Civil surgeon's office is doing this wrong - NOTHING is sent to Department of State for stamping - they need to complete whatever form - vaccines?, sing, stamp that, put it in an envelope, seal it, and give it to the applicant.  Applicant includes this when going to the interview (or mailing it in with their I-485). To be on the safe side, I'd even ask to see the form before it's put in the envelope and get a copy for myself, but that's just me.

She didn't say the Department of State - She said "The State"

Yes, she did  - the State dept.

Department of State = State Department. Again, NOTHING Is sent to DOS.

This tracks with what our CS had to do with Jaycel's Vaccine Assessment - They had to verify that the Colorado State Department of Health had registered the vaccine before they could complete and seal the I-693. @thakattack159 did you mean the Civil Surgeon needed to have the state sort and seal or did you mean the State Department as you said in your original post?

I am not sure what he was trying to explain, when i went to the civil surgeon's office, I paid for the vaccine assessment and a polio shot. They gave my husband a polio shot and said they will send the papers for processing and stamping and should come back in 2 weeks. I thought that the office itself would stamp, sign and seal everything and give it to me the same day. That is why I am a little concerned. Our 90 day hits on June 7th, so we still have a little bit of time. If it doesn't come back in 2 weeks, I will probably just submit with DS-3025 with the proof of polio vaccine separate and another cover sheet explaining what happened. 

 

And yes, I got the civil surgeon's office information to book appointment directly from the USCIS website.

I believe the CS said state health department like you said. I am in California. I guess it might be state dependent how this works. They said the state will sort everything and make sure that it is in correct order and seal it and send 2 copies, one for me and one for USCIS. So I should have a copy of everything too..but I do wish I could see what they are signing and including in the sealed envelope because I gave them a copy of the panel physician exam from India that I want them to include so they know why we only did a partial i-693.
