We're married for 5 years and have a child. My husband was working and meeting the income requierement for CR1/IR1 visa, but his chronic illnesses got more severe these past months. He's looking into social security disability as his health limitations are not letting him work. Can he sponsor my CR1 visa being on SSD? We're about to submit the civil documents and pay fees for NVC, he's still working but would apply for SSD in a month and get approved in 6 months. We're new on this, I appreciate your answers

SSI is not automatic and can take months (even years ) to be approved

Been thru this with my mom who had RH and lost a kidney and my son who has had 10 bad surgeries along with several other joints -all in all he had 42 surgeries and had to fight SS to be approved

SS is another federal government and nothing is fast or guaranteed

SS likes to deny cases and make you hire a good lawyer to prove a case

Even after getting approved ,  benefits do not start till 5 to 6 months from the day approved (they are for the amount from day of application)

But this income will not be available for your interview

Best if he finds a joint sponsor

and best to show u plan to work after POE to have health care for you and the son as if he is on SSI , he will be on medicare and can not add u

So very sorry he is this ill and my prayers are for the 2 of u to be together and happy

We don't have any joint sponsors nor family or friends support. Cause he re married and they all cut him off sadly. I am also disabled with 7 chronic illnesses myself so those options won't work. I can only work from home when I have some time as taking care of our 3 year old is 24/7

He would get approved as he is very severe and deaf. I guess the answer is SSD is not income to sponsor cr1 beneficiary?

It can be if documented and if sufficiently meet the approval of a Consulate Officer.

This is SSDI, not SSI.  He's still working, so should continue to work until the SS Disability is approved.   Chances are the immigrants will already be in the USA by then, making SSDI income for sponsorship a moot point.

Yes, if SSDI is enough, it can be used by a petitioner to sponsor an immigrant if it's enough.  Since it is not a part of the present tense of this case, that really doesn't matter.
