I'm filing out the I-765 and I-864 forms for both my husband and my step-daughter. I'm unsure which category to file them under for the I-765.

Is it "a6" "K1 non immigrant Fiance or K2 dependent" or "c9" which it states to apply under if you have a pending application for adjustment of status.

We are in the 90 days now... but *just* as he got here July 16. (I know! but I had school and a ton of stuff to do for it so I'm getting to it now.)

Also, on the I-765 form, Part 2, Item #25 "Your Current Immigration Status or Category" Would we put K-1 for him again (it;s the answer for # 24 "Immigrant status at your last arrival" )
Or would we put "Spouse of a US citizen" or something else?

 

Same question for my step-daughter: do we fill out # 25 K-2 or something else?

I looked it up and it states c09 is Tnonimmigrant for victims of sex-trafficking. It also says we must show proof of this status, so I'm thinking it's a6 ?

Best to become an expert reading the guides etc, not something you want to mess up.

 

As an aside I did the paper work, what is he doing?

Not sure what you mean, but if you mean why isn't he filling it out? It's because the language is tedious and confuses him at points. We tried having him do it alone before and it... was not good. There's a bit of a language barrier and we didn't want to make any mistakes. We are also filing with a co-sponsor.

From what I'm reading, I can't go wrong with a6. Also I read the instructions but can't figure out where else to look this up.

He has to potentially talk to immigration officer and explain all answers on forms during interview. So it's best you fill it together and he asks all the relevant questions. Immigrant owns all forms other than I-129F, I-134, I-864 and I-693.

Thank you, I didn't know it was possible to file for work auth before marraige. We'd have done that instead.

He can speak English, he juist doesn't always understand what these intense government forms are asking for. 
We are filling them out together though. He just didn't want to screw something up if he filled it out alone.

I don't know if anybody receives EAD when filing before marriage anymore. But applying for SSN before marriage would have been a nice move. Now he'll most likely to get SSN when he receives EAD or green card. SSN is good for opening joint accounts, getting on lease, starting building credit etc.

We did file the SSN and he has it. That's one of the reasons we're just getting to the paperwork for the I-864. It took a while to get the SSN appointment.

Another question for this form: 

 

Quote

Passport and Travel Document Numbers. If you used a passport or travel document to travel to the United States, enter either the passport or travel document information in the appropriate space on the application, even if the passport or travel document is currently expired.

 

So the passport that the K1 is attached to expires 10/12/25. He has his new passport already but the passport he came in on is the one mentioned.
Item 21b asks for the "Passport number of your most recently issues passport" Would that be the new one?

If so then would we put his old passprt number (the one the K1 is attached to and that he came in on in number 21c? where it asks "Travel document number"
