Hi everyone,

 

My husband is the petitioner who is a US citizen, and he filed the I-130 application for me last year. Our baby was born after the I-130 was filed so we hadn't included our baby related information in the application. The I-130 is still pending.

 

I wonder HOW we should let the USCIS know about our newborn baby, or WHERE shall we add information about the baby, and at WHAT STAGE exactly? Can we update the existing I-130 application, or shall we let them know during the interview stage?

Baby may already be a US citizen. Research crba to see if they qualify

Yes the baby qualifies for CRBA, we'll do CRBA for the baby. But what next? How shall we add the information about the baby for the USCIS? Or shall we not add anything at this stage? When is the right time to provide the info about the baby?

Once you get crba, apply for us passport. You would mention baby on the i 864 provided to nvc

Also please complete your timelines it's blank. We don't know how far along you are in the process.

I don't believe you do because the newborn is not seeking an immigration benefit. Other mor experienced members here could probably help.

Adding on @matea, you would also provide info of baby in DS-260 that you will be filing at NVC stage.

What to do is not a democracy based on how many opinions you here.  Get the CRBA, then mention the child in the I-864 and DS260 at NVC stage of the process.  Adding the CRBA as unsolicited evidence can't hurt, but the CRBA is stronger evidence than the birth certificate alone.

Thanks for the advice! I didn't realize but I agree that CRBA would be stronger evidence than the birth certificate.

In case I add unsolicited evidence, doesn't it hint the USCIS that the petition is either still incomplete or still in progress or maybe has some missing info and that's why we still add new evidence, and thus the USCIS thinks it's better to give us more time and increases the case processing time?
