This article says there is a new policy:  I can't vouch for it's accuracy.  Hopefully, you escaped this new requirement.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

yes this is state specific. However I have now sent him my EAD work permission and with that I should think it's an appropriate document proving I am allowed here. We had two conversations going, one with the WY immigration office dealing with driving, and one with the driving services in town....so complex man!

My USCIS account also skipped over the interview, but the reality is that you will likely be interviewed, especially with them stating all marriage based applicants, both pending and new, will have an interview. 

 

You should have recieved I797s in the mail, or can access the digital copies on your USCIS account under the Documents tab of your I485 application. An EAD would show status, without it you're current here on an expired visa, but not illegal, and they can't categorize you as anything to allow the issuance of ID. 

 

Driving on a foreign license is generally only allowed for the first 90 days of stay, but this varies by state. 

 

I recently got my learners permit, and for that I took all I797s from first filing to EAD approval, including biometrics letter, my EAD card, my passport with K1 visa inside, current I94, my SSN, marriage certificate.

The driving /immigration officer saw now my work permission and said I can apply to do the driving test whenever I want. WY asks for a new license after 1 year. Also if my daughter does not have the SSN yet and now they no longer issue them automatically when applying for EAD. we are losing 9k in tax refunds in October because of her lack of SSN. I bite my tongue thinking we should have done this a year ago.

It is painful, but tax returns can be amended in the future to get money back.

Ours showed the same thing after the biometrics appointment… then 7 months later we got a notice to appear for an interview. They then “unchecked” that step until we had the interview. Every marriage based adjustment of status now is required to have an interview. They no longer waive this requirement. This is right from the mouth of the USCIS officer that did our interview.

Update: USCIS has just taken action and our interview is scheduled for 23 September. I wonder if anyone would like to share what their interview was like? So many documents to bring, LOL.  And we do not have joint bank account, or joint bills. He has only electricity bill, really..... does the spouse remain in the room during the interview? I wonder if they ask questions to the teen children too..you know, the ones that reply with 'I don't know' and 'mmm?' To every question.

we just had our interview a few days ago - here's our experience 

might depend on the officer, but i stayed with my husband the whole time. 

are you on a lease or a mortgage? those are really good cause it helps show you live in the same place.

Thanks all for sharing your stories. Unless I bring photos of me in the house (and I literally have hundreds of our garden) I don't know what else to show as proof. I have a credit card in my name from his account and that's it. I have worked as a volunteer for his university...can't show 'evidence' and I won a design competition for the city banners last month which shows I've been in the city art world for months. :) I can't think of anything else to bring. We met in 2019, and after 5 YEARS we got married. I have photos of all the family reunions in Idaho and Utah! Does it count?

 

Here is another question. In October there is the second deadline for filing taxes. Is there any chance to get an SSN number before that so we can add my daughter to the tax exemption part? Looks like we will be too late. It's just too bad that this new rule has been added.

 

One more question. I did not have the flu vaccine and I am trying not to as it is summer after all, the new strain is not available, and I have not had the flu for 30 years.....but when I had the only flu jab I got the flu right away ha ha. DO you think they will make problems? So far they had the medical papers months ago and never asked for that. We did have the Covid Novavax vaccine months ago.

Oh man, this doesn't look good. Photos is the weakest evidence.

 

You need to get creative.

 

Did you take trips together? E.g flights and hotel reservations listing both names.

 

Amazon household, shared wireless family plans, Costco membership or museum memberships.

 

Affidavits from people who know you well (neighbors, friends, family etc)

We could not fly as no green cards we postponed our holidays in Europe. We have no tickets as we drove to Idaho and Utah. Maybe he has some hotel reservations for then. He is not on my Amazon and I am not in his.... what is an affidavit from a neighbor? all family lives 8 hours away...

just a next door neighbor, doesnt need to be family, to state they actively see you living in the house/being there full time
