I had to make an account. It also asked me to confirm what identifying documents I'd be bringing. From what I remember, I just took my passport with visa, I94 and proof of address.

 

Following that, I've learnt to just call my local SSA office directly to schedule appointments, but I know some places, especially big cities, don't allow you to do this. If not, you're stuck calling the national number and being on hold for 2+ hours.

 

But as @OldUser says, this seems to be an issue caused by trying to get an SSN after filing for AOS. I did have trouble updating my name on my SSN to my married name in between filing AOS and receiving my EAD, but was solved as soon as I was able to go to the SSA with my EAD card. And FYI I am currently looking at an estimated 27 months for GC, so it is possible to do before receiving GC.

@JeanneAdil provided the information to get an ITIN.  This is a tax number for people who are not eligible for a SSN and works fine for bank accounts and income tax filings.  Once the greencard or EAD are approved, then a SSN can be applied for.  

 

As for AOS, it may be soon that you hear something, @Dragonsarereal, but it may be another 6 months.  USCIS are unpredictable and the current administration has definitely moved the goal posts a bit on how they want things vetted, etc.  I'd honestly take the conservative approach and just apply for the ITIN.  If it works out that the conditional permanent residency is granted sooner, excellent.  If not, you're good to go.

The system here makes it so complicated to edit, reply etc. so I will try a grouped response.

Re. having the tax credit money back, this is a  good thought, but you can't do that with the child tax credit if the child didn't have a SSN by the due date of the original return (including extensions).  So if she doesn't have a SSN by Oct. 15, I couldn't later amend our return to claim the child tax credit.

 

Second, to OldUser, we tried online and could not, so we called the call center at the regional office and they said we could do it in person. At the arrival to the office, we were denied as she does NOT have permission to work. It appears that people are responding without having read the many times I have specified this.

 

Only after 2 days of writing here, my husband corrected me and reminded me that YES when we did the AOS we absolutely ticked YES for SSN number for both of us, and we also applied for EAD for me. However, while I did receive SSN and permission to work within 3 months, my daughter did not receive any SSN. Thus my questions re. tax credit, because we would save 2k if she had the SSN and was listed as a dependent.

She cannot apply for a TIN number because that is for non residents and she IS resident.

I did get a TI N number (or EAN? can't remember) some 10 years ago when I was living in the UK and working with Zazzle, and because I was non resident I received one.

 

I hope that this clarifies this total mess!

They have read it, but that's not necessarily required, as previously advised. They were discussing getting before AOS application, but that ship has sailed now. An ITIN is a good idea though - https://www.irs.gov/tin/itin/individual-taxpayer-identification-number-itin

legally she is not because she doesn't have a greencard yet.

greencard = resident, no greencard = non-resident

in this case you could get an ITIN for her.

Thanks. So I checked again and my husband said only SSN was accepted. I checked with IRS site and gemini and got this: The Child Tax Credit or Earned Income Tax Credit explicitly require a valid SSN (not an ITIN) for the qualifying child to be claimed. Therefore, while an ITIN would serve for general tax identification if your teen doesn't have an SSN, receiving the SSN through the immigration process is crucial for accessing these particular tax credits.

Please don't use generative AI for important matters such as immigration, whether it's Microsoft Copilot, Chat GPT, Gemini or something else.

 

As outlined earlier, the worst case you can get SSN later, amend taxes and get money back.

Oh yes, Gemini is usually 2 years late with anything, LOL. I actually asked my husband (a lawyer) to recheck the IRS and he confirmed that in this case we can't do much, Interpretation of immigration laws can be a minefield.  It depends also on the office working with that application. We will just await for the GC now.....meanwhile I sent an email to USCIS just in case.:) Thanks for all the help...!
