Pending case with USCIS now estimated time frame 34 months to be completed. Interview was in Islamabad, Pakistan in 2021 and went through multiple hardle finally came down to file waiver in February 2024. Now, waiting on USCIS to make decision on our case. It's for my wife in Pakistan and I am a U.S. Citizen residing in D/M/V area. Anyone going through similar case or know anything with updates based on this particular case. Please comment your thought or reach out to me. May be we can learn more about this process

So there was fraud or misrepresentation involved?

What exactly is your question - you have to wait and see the outcome of the waiver - it's either approved or not.

If you only applied in Feb 2024 then you've still got a long way to go. You may find others with similar cases, but you'd need to give more info - what were the reasons a waiver is needed?

I am not sure it particularly matters what the Fraud was, it is waiverable and in my experience it is unusual for a well prepared waiver to be refused.

My rule of thumb was 2 years, seems they are taking a bit longer.

So, they interview officer claimed we have misrepresented our wedding pictures. Based on the pictures they ask my wife to apply for a waiver. Which I have done already. I do have lawyers who's working on it and have submitted in February, 2024.

Your Lawyer will be notified when the waiver is approved.

For processing times look at the USCIS website, that's usually pretty accurate. As you say it's currently 34 months for 80% of cases, so you aren't likely to hear anything until 2027 ish.  If the waiver is granted, they'll then issue the visa.

What was the issue with the wedding photos and what other evidence of it being a legitimate marriage did you provide?

Our engagement ceremony were in 2018 and got married in 2020 right of the time of pendamic. So, the engagement pictures were more prepared / fancy than marriage since we did a small ggathering due to  it was end of February right when covid was anounced. I have provided all the legal proof of documents and history of us being together. Private chats/ calls and financial docx that I have been supporting my wife throughout. It was never enough for them sometimes.

Misrepresentation at least that's what they believe due to enagement (2018) pictures vs wedding pictures. (02/2020) During covid.

Many engagement and wedding photos are heavily staged. That's the point of them. I don't think they would accuse of you of misrep for that alone. Are you sure that's the full story? Perhaps it's a cultural thing I'm not aware of. Does Pakistan really validate marriages based on how orchestrated the wedding pictures are?

That really makes no sense.  If they believed your marriage is not bonafide, that isn't a "waiverable" situation.  Fraud is fraud.  There is more to this story.

I agree, something isn’t adding up. Were you at the interview?

This exactly how I felt after my wife interview. The officer said your marriage is valid I believe but I feel the pictures aren't justifying.
