Unfortunately, I wish that the system followed that process, however, the state in where the petitioner resides and files the I-130 ALSO has to deem legal/recognize cousin marriage.

 

That’s where my confusion arises. 
 

My idea is to move to a state where first cousin marriages aren’t legal within the state but recognizes first cousin marriages if performed in a state/country where legal. I am referring to Oklahoma btw if anyone is curious. 

Will USCIS deny my petition based on the above fact?

I would recommend you talk to a lawyer with experience in these matters. Based on your past posts on this topic you’re trying to find the exact minimum way to get the I-130 approved and visa issued.

 

When taking that approach legal counsel is a lot more useful than a forum as they’re trained to exercise professional judgement, provide you with advice as to the probability of various approaches working, and tell you their professional opinion as to what your options are.

 

Thats not judging you, by the way. That’s just pointing out you’re in an atypical situation and taking an approach that would benefit from a professional.

I'm not familiar with Oklahoma, but we had a member on here from Texas where it is illegal's and punishable. That member was told by the consulate to either move where it would be legal and send proof or the visa would be denied. 

 

I'm going to guess that since Oklahoma would recognize the marriage and not take legal action against you, it might be ok. If not the consulate will let you know and hopefully give you time to move.
