You might want to use your Congressperson.

 

I take it his Priority Date is current or not applicable?

Sorry to hear about your diagnosis.

 

People have expedited for health reasons for the USC petitioner, yes.  You need to write a succinct letter explaining the situation, and providing supporting documentation, such as a letter from your oncologist.  I am an oncology RN, and we have provided such letters to patients for immigration purposes.

OP, what is the visa category?  If a visa is not numerically available at this time, they cannot expedite it for any reason.

I am currently undergoing treatment for an illness. According to my doctor, based on a bone marrow biopsy, I have had this condition for over 10 years, and my prognosis is approximately three years.

My son’s asylum case was administratively closed because he also has an I-130 petition filed by his sister in 2018. He is married, living in the United States, and has two children who are U.S. citizens. The judge has allowed him to remain in the U.S. until the I-130 petition is approved.

I have already requested a support letter from the state representative and will be asking my oncologist for one as well.

Could you assist me by providing a sample letter template?

So you have not filed for him, he is obviously over 21.

 

Are you a USC?

 

Is he married to a USC?

 

Sounds like he has a Witholding of Removal.

I am an American citizen, my son is married, over 21 and has two American minor children. His wife is not a citizen.

If you have yet to file for him it will be over 14 years before there is anything to expedite. Not sure an expedite would even apply anyway. I do not see a basis.

If you filed for him before 2011 ish then that is possible, I would use your Congressperson.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So the Priority Date will not be current until the 2040s, there is a long queue in front of you.

There’s no visa available to him by law, an expedite can’t change that. 
 

But if he’s already in the US then even if his PD was current (and you could therefore apply for an expedite) I can’t see any grounds for one as he’s already in the country with you. That said, you say the judge has allowed him to stay until the I-130 has been approved but are you sure about that? It would be odd as even after the petition is approved there is likely to be many years until he gets a visa. 
 

I’m so sorry about your diagnosis but glad that your son and his family are able to be with you now and enjoy time together.
