questions about i485 and i864

I came to America with a K1 visa. My fiance and I got married and we will start an AOS application, but since her income is not enough right now, her father will be our joint sponsor, but we are confused about which i-864 forms to choose and fill out

 

There are 4 of us in the house, my wife, her father and her mother. Only my wife and her father are working. Her mother is not working. Her father is the one who will support us. Which i864 form should we use in this scenario? The standard one or other versions? And does her mother need to fill out a separate form like i864a even tho she is not working? I am looking for an answer regarding who should fill out which forms in our issue

You have a couple options.  The cleanest IMO is to have your wife and her father each fill their own I864s and have her mother fill out an I864A even though her income is $0.  I believe this is the cleanest as the AOS takes some time to process, and who knows if you and your wife will decide to move out to your own house or apartment before the AOS is finally decided.  If you know for certain you will not be moving before the AOS is decided, she will still fill out an I864 and her father can fill out an I864A as a household member at the same principle address as the I864.  Her mother should still fill out an I864A in either case.

thank you much but if the family member doesn't have any additional income to add, should they still file an i864a cause when I asked chatgpt it said it wasn't necessary so I wanted to be sure

If they file taxes jointly, it can be requested by USCIS or a consulate.  Essentially, they are making sure that both parties are in agreement to the sponsorship.

The I-86a shows the USCIS officer that the spouse of the Joint Sponsor is aware of the obligations of sponsorship.  I agree with @Dashinka.

Since her mother and father filed the taxes together, it would be appropriate for me to write the figure on the tax return, right?

Since it says sponsor in the i864a form, who should fill it in and how in our case, my wife or her father? There is also another place like this that the household member will fill in. I understand that the mother should fill it in, but who is this sponsor part for?
