Hi!  EB-5. “Capital can include Investors promise to pay (a promissory note) in certain circumstances”. In this case, do I have to prove that I have the full $800,000 (in the case of a TEA investment)? What are the “certain circumstances”? Is it difficult to convince to make a promissory note instead of investing all the money at once?

One of the requirements is that you can show a clear trail for the investment.

The government does not take your investment, well I assume you mean the US Government.

Hi! EB-5. Will the government refund investments made in TEA under the EB-5 visa? What are the chances that the government will not return the money?

Update for 1st question:

What is the normal and maximum acceptable term for repayment of a promissory note for an EB-5 visa?

Update for 2nd question:

EB-5. Will the government refund investments made in TEA under the EB-5 visa? I don't mean income. I mean a refund, like how it's done with a borrowing (I know you shouldn't give money as a loan). If it is not the government's responsibility, will the TEA return my money?

What are the chances that I won't get my money back?

By the way, separate from returning the “borrowed money”, will I have a profit from my investment in the TEA?

Is there a TEA who want a promissory note? Seems an odd thing to do, you want to stage your investment?

The return on investment, and of course the return of capital will be dependent on how well the TEA performs. I like to look at is as buying a GC. I am sure there are good TEAs and not so good ones like any other investment.

no promisory note are accepted but certain regional centers will allow installment payment during the i-526 process. so you dont have to pay the full 800k at the start of EB-5 process. again the terms are set by the regional center you invest with. USCIS has said that partial payment process is acceptable to start the process.

Talk to the regional center that you are investing with

As Boiler said, look at it as buying a green card. You may get your money back, but there’s no guarantee - don’t do it if you haven’t got that kind of money to lose.
