Filed our N-400 online 07-31-24. Receipt was immediate and we received the NOA letter a week later. Since then.. nada. USCIS's own estimate at the time was 7 months so we thought we would hear something by February '25. It's now the end of June.

 

The Dallas field office is currently running 8 months for 80% of the cases so we are well outside the normal processing time. I went ahead and sent in the "Case Inquiry" today.

 

Does anyone know if the Dallas office does combined N-400/I-751 interviews?

 

Conditions..

Case status on both the N-400 and I-751 is "Being Actively Reviewed", which of course means little.

Removal of conditions

05-02-23 I-751 sent via FedEx.

05-03-23 I-751 delivered to USCIS address in Tempe AZ.

05-09-23 Check for $680 cashed.

05-15-23 Received I-797 NOA (48-month extension). A separate letter saying biometrics to be re-used. A third letter giving online access code.

Our field office was Dallas

In Aug 2022, wife's I-751 had been pending for 40 months (filed in March 2019).  Wife filed N-400 (5 year rule) on Aug 7, 2022.  We had a combo interview on Dec 14th, 2022.  Both I-751 and N-400 approved. On Jan 23, 2023, wife took oath in Plano.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes OldUser, as I mentioned in my text I sent the inquiry today. Also added our joint 2024 Federal Tax Return transcript. They now have five years worth of tax returns.

 

No, haven't moved. They have our correct address, email address, and phone number.

 

There is nothing out of the ordinary about our application. It's about as plain vanilla as they come.

If you don't get any traction, mandamus might be the next step to consider.

If you don't get any traction, mandamus might be the next step to consider. 

 

A lot of trouble and expense to file the petition and from what I read the burden is on you to convince the judge that you're being wronged in some manner and that you have exhausted all other means of finding a solution. This is from an article I read online from a lawfirm that specializes in Mandamus.

 

  • You have exhausted all other administrative remedies, indicating that you have pursued every available option, such as appeals, reconsiderations, or other administrative procedures, without achieving a satisfactory resolution to your issue.

Yes, even though @igoyougoduke posted DIY guide of filing mandamus yourself, it's typically filed by a lawyer.

 

At that point, the only barrier is cost, it's typically about $5k+ (mostly lawyer fees).  But anybody who waited over a year after filing N-400 typically gets traction after mandamus.

 

The most fun part though is... Actually, almost every time nobody has to go to court or see judge. Once mandamus is filed, it just pushes USCIS to do their job within 60 days. USCIS adjudicates case, lawyer withdraws mandamus and nobody goes to actual court hearing. Essentially, the last thing USCIS want is to get involved in legal proceedings. And they do everything to avoid it.
