I just started my minor step sons i130 (ir2) last night (did not submit it yet) and then spoke with my husband this morning and he got a call from my step sons grandpa. My step son was arrested and was held on charges of illegal concealing and carrying a loaded illegal firearm. Needless to say we're quite upset with him and his behavior, especially after we had previously explained to him, because of some poor choices and bad behavior, the possible reprocussions for having a record. An investigation has been opened and therefore were all waiting to see what will happen with the case. If something like this ends up on his record what are the chances (if any even) of him being approved to come here? If he ends up facing jail time does that affect anything differently? It's besides the point that i'm reconsidering my offer to bring him here in the first place based on the obvious and other previous observations and during the past 24 hours.

It won't let me re-edit this but translating charges is difficult. Illegal possession of a firearm and illegal unregistered firearm were the charges.

so very sorry he has created a situation that will be difficult to overcome for a US visa /as he is underage ,it may or may not appear on a criminal report but u would have to disclose it along with the police and/or court papers.

If I were you, I would reconsider bringing a 17 year old with such a record to the United States. His behavior is going to worsen once he gets here. Don’t take that risk. Good luck to you!

Putting the question to one side if you should really go there, I assume most people would not, this is not a DIY case, you will need a competent US Immigration Lawyer and they will no doubt need to liaise with a local lawyer.

Thank you all for your kindness and assistance. I am absolutely still pondering reconsidering my offer to him. This situation is still very new so I have not processed entirely from the standpoint of if I even want to continue, which at this point is pretty well, no. I just wanted to see if it was even possible. Thanks again to you all!!

You have a few years, after 21 it gets much longer so why not see how things pan out.
