as long as your aos is submitted and pending ur ok. just dont leave the united states without advance parole. there is nothing else to do except wait now.

my husband has been living here for a couple years without his active visa. it expired a long time ago. we are hung up in fbi namecheck for his green card so we just keep renewing his work authrosation and advance parole.

ABSOLUTELY DO NOT LEAVE THE U.S.! This is what happened to my hubsband. Even though we were married and our I-130 had been approved, he had an aslyum appeal that had to be dismissed so his file was not complete. We have had to go through the process of filing an I-601 application for a waiver for him to re-enter the U.S. This process has taken us 3 1/2 years so far and it could still take another 6 months before we get a decision on his application.

Don't let this happen to you!

No it did expire today, your Visa expired the day you entered the US. K-1 Visa is a one time entry, valid to enter the US once then expires on its own :)

Your I-94 is going to expire TODAY.

Sand however is K-3... a bit different set of facts and circumstances....

YMMV

chuckandkim,

But, as a point of interest, a K1 visa isn't dead yet when the holder enters the USA.

Yodrak

.... K-1 Visa is a one time entry, valid to enter the US once then expires on its own

.....

Really? I do not know that... thinking logically, one-time entry, once you pass POE, it's done! :) Not really useful for anything else, or is it?
