Adjustment of Status - tourist visa

Hello all,

 

I have been a US citizen for close to 10 years. I never applied to bring my parents over, as they never showed interest in relocating to the US. But we have been thinking about this lately, as they would like to be close to us.

 

They will be visiting the US for the first time on visitor visas soon.


I have couple of questions, if I may:

1) As I understand, we can apply for adjustment of status (I-485) 90 days after arrival, correct, if we decide to pursue it?
2) Would we also need to submit the I-130 form?

3) Do they need to stay in the country while the adjustment of status is in progress and how long will it take to get the green card?

4) Would it be better if we apply after they return back home? We could possibly submit the I-130 form while they are in the US, if that is allowed, since they will be here for about 4 months.

Oct 10, 2012 - Received NVC case number and INN (by e-mail)
Oct 10, 2012 - Received AOS fee invoice (by e-mail)
Oct 11, 2012 - Sent DS-3032 (by e-mail)
Oct 12, 2012 - Paid AOS fee online
Oct 16, 2012 - Accepted DS-3032
Oct 18, 2012 - IV bill generated
Oct 18, 2012 - Paid IV fee online
Oct 22, 2012 - Mailed AOS package
Oct 22, 2012 - Mailed IV package
Nov 8, 2012 - Case complete at NVC (notified by phone)

Consulate:

Jan 29, 2013 - Visa interview

Apr 10, 2013 - Visa issued

Apr 24, 2013 - POE (JFK)

Adjustment of Status is not available to them.  You should file an I-130 for each of them to start consular processing.  They can possibly visit during the process.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Absolutely not, that is immigration FRAUD.
