0recently Filed An I30 form for a relative. I forgot to answer question number one . I recieved a I-797C Notice of Action stating missing information the first question wasnt answered. Along with the Appilcation, the cashier check, and supporting documents I submitted. green paper was attached as well if I choose to resubmit to place it on top stating a case wasn't created as well. My question and confusing is do i need to send a new filing fee or is my cashier check still valid for when i resumbit. cashier has been stamped by immigration and I sent it before April 1st . The fees have gone up as of April 1st so do i need to submit the new filing fee or what? and should i just answer question number one or refill out the new version of the i130 Appilcation.

If the cashier's check is not equal to the CURRENT fee, then you must send a new, correct payment. 

"You must meet ALL requirements as of the date of the new filing"

Personally, I would send a new I-130 just to check the accuracy.

So is my orignal money lost??? That they sent back stamped or could i get my money back from that miney order. I understand i have to submit a new fee.

Contact the issuer.  I would think the answer is yes, you can get the money back  if USCIS returned it to you.

Do you know if i can just mark the 1st question i missed which is what caused the rejection as far as a read the Appilcation i used is still valid till june 3rd so im not seeing a reason to redo the application rather correct my mistake someone told me to just correct it and sign and date next to the question i fixed instead of filling out the new version thats available now

Mark the first question, then very carefully review every little bit of the form, before resubmitting.  That they mentioned you not answering the first critical question, does not mean they even looked further at your submission.  Review the whole package.  Check the instructions for the I-130 to be certain you submitted all the "required" supporting documentation.

Since you are the purchaser of the financial instrument you used for your first payment, the issuer should only charge you the difference for a new one for the increased fee.

Thanks, So i can resend the 1st money order that they stamped and just get a second money order for the difference to cover the new fee will they accept two money orders to cover the cost?

I would get a new money order or cashier check. Or submit a personal check. That way it's easier to track

it's an cashier check sorry not a money order I was told the check is still valid because no case was created or filed yet so im wondering should i submit the stamp cashier check with another one for the difference to cover the new filing fee since my cashier check is for the old fee

I suppose it would work but they probably prefer one check. I would see about getting replacement from the bank as it hasn't been cashed. In the future just write personal checks as it is easier to track and write a replacement if necessary

I would not do that.  It might work, but it might get it sent back.  I said it the way I meant it, the first time, but I guess it wasn't clear.  Return the first money order and buy one for the right price.  You will only pay the cashier's check issuer the difference.

 

The priority is not your convenience.  The priority is to make it difficult for them to cause you a problem.
