Entering US on CR1 Visa - converting to IR1 at port of entry

Hello, I will be doing my visa interview next week and assuming all goes well (I've done the medical and have all the documentation ready), I will be granted the CR1 visa shortly. However, I am not planning to travel/move to the US until March of next year, which will be a few weeks after my 2nd wedding anniversary. 

 

A few questions: 

1. Will I be automatically granted an IR1 visa upon arrival in the US, or is this something that I will need to bring up to the CBP officer? 

2. If for some reason the CBP officer is not aware of the CR1 to IR1 conversion rule, and only grants me a CR1 visa, is there anything I can do to convert it afterwards?

3. What happens after I arrive in the US with my CR1 visa? Do I just hand over all documentation etc to the CBP officer, is there another interview etc?

Then you should receive an 10 year Green card automatically.  You can mention it to the CBP officer if you want, but USCIS (not CBP) determines 2 year vs 10 cards.  If USCIS mistakenly sends the wrong card, you can file an I-90 to correct their error.

 

There is no 2nd interview after arriving via a spousal visa.  However, they might ask a few questions.  Nothing to worry about at all.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Make sure your CR1 visa doesn't expire by then.  You should be given 6 months from the medical, but there have been cases when it was less.
