It means that it is just for questioning- not being charged.

If I might chip in here: I'm german: if the wording is : wird zur Last gelegt - it means, being accused of.But not charged - that's a difference. It would need to say : sie werden beschuldigt .....und

Her answers to 1 and 2 were correct.   No need to worry.   Why do you think has to be disclosed to the embassy?

I'm not sure why you're concerned about this as long as the version of events you shared are accurate. She wasn't arrested or convicted and you say she didn't violate any drug laws. Don't overthink it

Thank you all for your replies. This was very helpful. Just to clarify, after looking over the DS-260 there don’t appear to be any questions specifically pertaining to this. So basically this will be a straightforward application and doesn’t need to be disclosed unless they specifically ask about being questioned by the police in the interview?

Correct.  In all my years here, I've never heard of the question, "Have you ever been questioned by police?"

Facts are cheap...knowing how to use them is precious...
