Your husband can't travel to Mexico and wait out the process?   I wouldn't bet on MIL getting a B visa.

It is her money, but with a prior refusal and whatever the reason is for her sons waiver it does not look good.

I corrected my earlier post, not sure why I got the gender wrong. And the rest I blame on fat fingers, auto correct and using my phone. And of course not checking.

 

So I 601a generally means someone hopped the border, not eligible for DACA and the only issue they have is a stay in the US longer than 6 months over the age of 18.

 

You get the I 130 approved then the I 601a and pop back for the interview and come back with an immigrant visa.

 

Leave without the I 601a then you attend the Consulate interview and have to file a I 601.

 

As with everything timelines are all over the place but it seems I 601s are taking 2 years, I 601a's 3? years. Anyway obviously better to get it done in the US if you can that way you will be gone a few days not years.

I seem to remember a couple cases where the CO wanted an I-601 after the interview (even after an approved I-601a).  However, it was a few years ago, so I might be mixing cases.

That does happen, I 601a only applies to overstays. Not for example a criminal issue.

With his illegal presence, I would think the consulate would expect mom to do the same thing.   What reason would she have to return to Mexico?  That’s what they’ll want to know….

I have come across people in this situation getting a B, I assume they are the exception that proves the rule.
