I'm now on the way to filing my AOS. I have just had all the blood tests and Tb test done in the US which were fine. My main concern now is the physical part of the exam particularly the mental Health exam.

The reason I am filing the AOS is based on the approved I360 based on the abuse I suffered by my ex husband. During our marriage it got to the point where I couldn't take it any longer, was so scared and frightened that I voluntarily went on to a pysche ward for about 5 days in December 2004. The day after I came out the abuse continued by him and his mother and I just wanted to sleep and get away from it. I ended up taking 6 Ambien sleeping tablets and drank two glasses of Vodka and orange. I really didn't know the strength of the tablets and fell on to the floor. My in-laws called for an ambulance and I stayed in hospital for a day. I insisted I was not suicidal, which I was not

I still take medication for anxiety and depression (NOS) and PTSD but I am fully able to functionsocially and help in the community . The reason the depression has continued has been due to my lack of an EAD for two years , whereas before I was a schoolteacher fully employed for 5 years, not seeing my children and the actual process of waiting for nearly 2 years to get a decision on my petition.

Since 2005 it has been noted that I do not have any suicidal or homocidal idealations in my doctors notes . I have never ever considered doing this and this " self harm' which I suppose it could be called only occured due the abuse I endured. This evidence was actually used to prove extreme cruelty. I am so worried now that when this is mentioned at my medical that I will fail the exam. If I have to file a waiver there is no way I can prove hardship. Has anyone ever passed the medical under these circumstances? I have come so far and waited so long to finally file my AOS.

Never heard of mental health coming into question during the medical. I was under the impression it was purely physical (chest xray, aids test, and so on).

I went to have the (full) Immigration Medical done by the Civil Surgeon here in the US and there wasn't any mental part.

My belief is that they only do that if they have a doubt on your sanity when they see you. Which I doubt is your case.

I was asked what medication I take though, so since you are taking some anti-depressors, they might have a few questions. But I doubt there is anything to worry. Bring your record from your doctors in case they ask for it. But I'm sure you'll be fine.

After all it's not like you'll walk in the office acting like someone who asked a ward ;)

Do they not ask for a medical history like they did when I went for my K1 medical?

When I went it they took my driving license and SS# (since I have one) and my medical record (vaccinations), then I went it to wait. A nurse called me, asked my name and birthday (to make sure I was the right person I assume) and just asked me a few questions like if I was pregnant, what medication I was taking, and that's about it. Nothing too personal really.

The doctor himself only sticked to filling the vaccination supplement thanks to what I brought him and do the physical exam. He didn't ask me anything about my medical history or mental state.

Then they did the TB skin test (nurse again) and that was it.

Shona,

You can get a letter from your Therapist or Dr. to state exactly that.

There were several people in the UK forum that had to get letters about their depression or other malady. They got approved without a problem

It talks about having to take a complete medical history etc and goes into detail about class A and Class B "mental" conditions and the various scenarious.

I'm just feeling scared and sick of being scared of this process.

Just to add I was planning on getting a letter from my doctor, but I'm not 100% sure what it should say. I know people say not to given anymore information than is asked but wouldn't it be classed as wilful misrepresentation for concealing a material fact if I didn't say anything?

Just take the letter with you and only give it if they ask questions about your depression.... treat the CS like the USCIS ;)

They don't ask anything at all - you're in and out of the office. You don't have to take clothes off, and there are no questions about mental health whatsoever. At least, that's my experience - the medical was painless :)

I had 2 medicals.........one in Australia which was quite thorough......a lot of questions and strip down to underwear etc..........and I had one in US. The one in US was nothing like the one in Australia...as someone said in and out in a mter of minutes.

I. INTRODUCTION AND BACKGROUND

A. THE MEDICAL EXAMINATION AS PART OF THE

APPLICATION FOR ADJUSTMENT OF STATUS OR ADMISSION

Aliens applying for adjustment of status to permanent

resident must have a physical and mental examination as

part of the application process. The Immigration and

Naturalization Service may also require aliens applying

for admission into the United States to have a physical

and mental examination if necessary to determine their

admissibility. The purpose of the medical examination is

to identify the presence or absence of certain disorders

that could result in exclusion from the United States

under the provisions of the Immigration and Nationality

2. Mental Conditions

Under the old law, aliens who were mentally retarded,

insane, had one or more attacks of insanity, were

afflicted with psychopathic personality, sexual

deviation, or mental defect, or who were narcotic drug

addicts or chronic alcoholics were ineligible for

admission or for adjustment of status to a permanent

resident. As amended, the Immigration and Nationality

Act no longer lists specific physical or mental

conditions that automatically exclude an alien but

instead requires a determination of whether an alien

has a physical or mental disorder and associated

behavior that has posed or is likely to pose a threat

to the property, safety, or welfare of the alien or

others.

I don't think you should be too worried. You would have to be truly insane/delusional/psychotic and readily display associated behavior at the examination for the CS to focus on the mental assessment. Otherwise, for most people, I don't think the patient even knows that they are being assessed for their mental health. As many posted on here, they had no idea their mental health was being assessed as part of their "physical" exam. :)

So don't worry too much shona. I think you'll be fine.

You would have to be truly insane/delusional/psychotic and readily display associated behavior at the examination for the CS to focus on the mental assessment. Otherwise, for most people, I don't think the patient even knows that they are being assessed for their mental health. As many posted on here, they had no idea their mental health was being assessed as part of their "physical" exam. :)

I agree, I think that the "mental exam" is their normal evaluation of the person. Like if you are sitting in the dr exam room and acting all weird, they may start to suspect that something is not right with you. People have depressions and get out of them, no biggie.

Shona, I think you'll do fine. I wouldn't mention any details or medications unless they specifically ask... and then I'd only give bare minimum info. And if they ask why you are still on meds, just say for anxiety and don't go into the full explanation of your story. The less they know the better.

My concern is though they will have my VAWA file at the interview with all the details I mentioned above. Won't this conflict with what the doctor states and what is written in my file ?
