N400 interview scheduled while ROC pending

Hi there! I filed for removal of conditions in sept 2021. SRC and then transferred to NBC. I’m having my N400 interview next month in Houston. My letter did not say anything about a combo interview. Should I mention it to the officer? 
 

Do you guys have a list of paperwork I need to bring to the N400 interview? Is it okay not to have a lawyer present?

Make sure your US citizen spouse comes with you.

 

Yes, do mention pending I-751 to IO.

 

Bring your passports, GC, spouse's Birth Certificate or Naturalization certificate, marriage certificate, tax returns for past 3 years and all other bonafide marriage evidence.

 

It's OK not to have a lawyer if you don't have a difficult case.

Yes, you should mention the pending i751.

However, you should assume you will have a combo i751/n400 interview. If your ROC is a joint application, then you should bring your spouse to the interview, along with additional updated good faith marriage proof. 

 

It is common for the USCIS field office not to indicate on the appointment letter that it will be a combo interview will happen. At our interview in Sacramento last May the invitation did not indicate a combo i751/n400 interview but in fact it was. So, you should expect that it is a combo interview. Sometime USCIS field office is not prepared to do the combo interview and will only do the n400, if so, your case will take longer to get approved as your n400 cannot be approved until the i751 case is approved.

Bring what you are directed to bring in the n400 invitation. The original documents you use as evidence submitted with the n400 application like US birth certificate, naturalization certificates, wedding certificate, divorce decrees, latest tax transcripts... I would also bring current IDs for you and your spouse. 

 

With a n400 under the 3-year rule it is always good to being your spouse just for that interview. But with a possible i751 interview it is 100% required to bring the spouse or your i751 & n400 cases may be denied.

Yes, it is 100% okay to bring a lawyer with you. If you have any complications in your naturalization case like any criminal record, arrests, or complications in your marriage during the AOS/ROC cases, you should bring a lawyer.  

We did not bring a lawyer to our interview as we had a straightforward case, and if you have had no issue with your background to raise an issue with your good moral character then you can get by without a lawyer there.  

 

It never hurts to bring a lawyer, it's just expensive. In some cases, they are needed to protect your rights, but in most cases, they would just be there to reassure their clients. My understanding is most n400 applications do not have lawyers at the interview and get approved every day.

so far I have these documents to prepare for a combo interview, let me know if I’m missing something? 

- my passports 

- copy of gc

- drivers license matching current address 

- previous drivers license matching old addresses 

- house deed 

- mortgage statements with both names on it 

- tax transcripts for the last 4 years of filing jointly and tax returns just in case 

- original marriage certificate 

- original US spouse citizenship certificate 

- life insurance with beneficiary info 

- 401k with beneficiary info 

- ROTH IRA with beneficiary info 

- previous leases with both names on it 

- AAA car insurance with both names on it 

- AAA home insurance with both names on it 

- bank statements all the way to 2019 with both names on it 

- copies of matching credit cards to show we share a joint credit card account (so same cc but with our names)

- utility bills - they only have my spouse name but show me as an authorized user 

- wifi bills on my name and on her name we have the gas, water, electric (but I am authorized user for all) 


then we have the less important such as: 

- trip itineraries 

- photos 

- showing same informed delivery throughout the years (both of us getting mail to the same address)

- concerts 

- dog pet insurance info
