Hi all.

Well to start:

I am a male, 17 years old (18 in november) and am a UK citizen.

I have never had any criminal record

I don't have any kind of disease or illness

I have never been deported from any country

I have been refused a B2 visa because the immigration officer didn't think I needed to be in the US for 6months.

The situation for me is:

I have visited the US 2x this year on the Visa Waiver Program, January 1 2007 > March 28 2007 and August 24 2007 > July 21 2007

On July the 3rd me and my fiancee sent off the I-129F petition to the USCIS and it was received and we have our receipt number.

I have read from a lot of sites that if I try to re-enter the United States on the visa waiver program (I wanted to return to the US to be with my fiancee witihin a month today) I will be turned down or there is a very high chance of denial.

I do not know what to do :(

She can't come visit me in England because she has a job.

What am I meant to do?

Please any help would be appreciated.

You've made an error in your dates above. As for what you are meant to do, I suggest you read the guides and learn about the marriage based visa process, including the K1 fiance visa. What most foreign fiance(e)s do is go on with their lives while they wait out the visa process and visit when they can. Join the club.

You've made an error in your dates above. As for what you are meant to do, I suggest you read the guides and learn about the marriage based visa process, including the K1 fiance visa. What most foreign fiance(e)s do is go on with their lives while they wait out the visa process and visit when they can. Join the club.

I meant April 24, not august :/

Welcome to the club of waiters.

You can try to enter the US and visit her but as you said there is a high chance of getting denied.

I myself would wait until the process is over and I have my Visa.

I dont know if you have to be 18 to file the Visa though cos it says you have to be "legally able to marry" and at 17 your not able to do that.

You might want to get some info on that.

You can try to enter the US and visit her but as you said there is a high chance of getting denied.

I myself would wait until the process is over and I have my Visa.

I dont know if you have to be 18 to file the Visa though cos it says you have to be "legally able to marry" and at 17 your not able to do that.

You might want to get some info on that.

The OP is not the USC, so won't be filing the petition. When his USC fiancee files, she'll need to include either permission from the foreign fiance's parents, an indication that age 17, is legal to marry in her State, an Statement indicating their intent to marry in a State where 17 is legal etc.

The actual statement is "If either of you is of an age that requires special consent or permission for you to marry in the jurisdiction where your marriage will occur, give proof of that consent or permission;"

In my opinion, although there is a risk that if you try to enter usa while the visa is being processed, the general consensus seems to be that as long as you take sufficient proof of ties to UK (such as bank statements, letter from landlords, letter from employers etc) you shouldnt have much of a problem. Of course, it depends on the risk taker in you...most people sit it out and wait for the 6 months or so for the visa to be done, thus not putting their future in any risk. I personally think that being from the UK and being able to do the VWP makes it more likely that you will be allowed to enter the states during the visa processing but again, its going to be slightly risky.

My advice...just sit back and wait it out, get a job in UK and save up for the AOS payment!

Edit...also, fill out your timeline so others have more info on which to offer advice!

YOu have already visited the US for 6 months this year, (you imply) you do not have a job & you have a filed a K1. You will likely have a hard time proving non-intent at the border as you do not have strong UK ties.

If she has holiday then a visit in the middle of the process helps to break up the wait and she can bring the items you will need for the interview with her (Affidavit of Support, certificates etc.). I think most of us would like to be with our fiance's a lot more than we are able to be.

I'm sorry to say this, but I think you have a high risk of being denied entry once you arrive in the US. You've made several trips to the US back to back. My fiance did this (before he was my fiance) and on his last trip here he was nearly denied entry. It was VERY scary, and I really believe that if we had already filed for our K-1 he would not have been allowed to leave the airport with me. We decided that would be his last trip until he was granted his visa.

I recommend you save your money and don't purchase a plane ticket just to arrive in the airport and then be sent back. There is a chance that you will not be turned away, but in my opinion, it is small.

If you do decide to try to enter the U.S. again make sure it isn't for a long period of time. My fiance was planning on staying 3 months and the immigration guy who finally allowed him to stay (after MUCH questioning and looking through proof of his ties to the UK) he told him he could leave with me, but he would have to return home before 90 days were over, "WELL before 90 days were over". They are very intimidating people :P. Also, make sure you bring a ton of information that ties you to the UK, like utility bills, proof of property, etc. This may be hard to find at such a young age.

Many people on here have not seen their loved one(s) for months. It's something many of us have had to get used to, but we know it will be well worth it in the end. Good luck with whatever you choose to do.

I'd spare yourself the grief and likely turnaround at POE and have her come visit, or meet in a third country (Canada?).

Lots of us have jobs, but we also have made time to go see our fiance/e's, too. Is she not entitled to days off?

yes; with a bit of care you can manage all sorts of things... my fiance's coming to visit (finally!) in September; by taking days off work around a public holiday and flying straight after the working day is finished on a Friday he'll be here for nine days, and only lose four days' holiday :D

we're going to Prague... canNOT wait; it's been almost nine months since we saw each other :(

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

I did visit my fiance once while our K-1 was pending. No questions were asked at the border of Philadelphia. Even when she asked whom i was visiting and I said it was my fiance, she only asked for how long we've been doing the Long distance thing and she wished me luck.

The other time though I was interrogated by an Minneapolis officer and even asked for my fiance's ceel phone number and told him, that if I was lying he was going to sent me back and would get a bar.

And poor him was shopping at Safeway when he answered that call. :huh:
