I'm mailing my package tomorrow. My only copy of my divorce decree is my original copy with the certified stamp on it. Is this okay to send??

Also, it's two pages that are stapled together...but the 2nd page doesnt have the certified stamp on it. Only the 1st page. I was told this is no big deal by the courts because the 1st page has both me and my ex-wife's names on it...even though the judges stamp/signature is on the 2nd page.

Will this matter?

Also, my decree looks pretty raggedy because it was stapled and unstapled so many times and tossed around. Does that matter??

Send a copy of it... your original certified copy should be maintained in your possession. If you send it in you will NOT get it back.

Send a copy of both pages and highlight the part that says "Absolute" just so it is extra visible.

Unless an original is explicitly required, send a copy on all items. Far, far safer.

I agree with sending a copy but not all States use the term "absolute" on their divorce decress. MA does, but that's the only place I ever heard of it.

That said, what you really want is a government issued "certified copy" of your divorce decree. It is actually an extract of only the vital statistics. It contains nothing about the settlement. I would obtain at least on of those and get it and a photocopy of it into the hands of your fiance so she has it at the interview if asked. Then make sure she brings it with her to the USA so you don't have to pay for another one.

Facts are cheap...knowing how to use them is precious...

NO...you need originals. I just asked this question today. Also my attorney told me I needed originals. Read this Thread. Also send them copies and they will look at originals and keep the copies. Good luck.

You are mixing issues. The OP is filing a petition. He does not need to send original supporting documents with the petition. An original "Certified Copy" should be available for viewing, if asked, at the interview. What is "Original" on a "Certified Copy" is the seal. Do you think that if THE "original" divorce decree was lost or destroyed that you would be dead in the water?

You probably photocopied a Certified Copy and your attorney is asking you for the original Certified Copy.

Pushbrk is right since you are filing your INITIAL K-1 package. All you need is a copy; I don't believe it will need to be stamped or have a raised seal on it. In fact I sent mine in on the initial K-1 package and all I had was signatures as you are saying.

I am sorry if I confused you, however you will need a "certified" copy of the original. (i.e. raised seal, court stamp) when your SO has the interview. That I know for sure. Yes, of-course you don't need the original, the "real one", when your SO has the interview. Of-course people lose these and just go to courthouse and get a certified copy of the original.

I really think you will be ok with you intitial K-1 package. I have just had a tough day concering originals and copies, while preparing for my SO's interview. I don't want people here on VJ to have to go what I am going through now. Again I am sorry for the mis-understanding.
