FE NOTE TO SUBMIT 1099 FOR 2020

Timeline

We submitted all the W-2s for 2020 and 2021 but they keep asking TWICE by FE note for 1099s when my joint sponsor is an employee and doesnt use 1099. What should I do?? Ist FE NOTE IN MAY AND NOW IN JULY SAME NOTE. HELP

Don't you have IRS transcripts?

 

Reply to what RFE is asking and slide in the transcripts. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Go to IRS website and get transcripts for 2020 and 2021.

W2 does not prove if you have filed the taxes thats why they need Transcripts. 

This time I would submit

W2s

Transcripts

Two recent paystubs

I submitted all of these and they were accepted with no issue

 

Also add to response note explaining why joint doesn't use 1099

Yes of course we submitted then since they are essential documents and not additional. The income of 2020 adds up to the W-2s submitted also so I dont why they keep sending this note and delayed me 6 months so far. Any ideas please help!!!

The transcripts were also submitted.

1. Is the Petitioner/ Sponsor employed , self employed or unemployed? I think you are having a problem with the Pet/ Sponsor…NOT the Joint Sponsor . 
 

If Joint sponsor is W-2 employee and his tax return shows that’s his ONLY income then he is clear. But do double check his tax return if it has any other income ( example sch C ).

My mom is the petitioner and she is unemployed. Her brother is the joint sponsor and he is a W-2 employee. WE JUST double checked and the income in transcripts does add up to the W-2 s of 2020 but they asked for 1099 in may and now again in july .Dont know what to do!

Then Google Congressman where mom lives and have her ask for help getting untuck from NVC
Unless of course mom gets Social Security ( non taxable) and there are 1099-R for her  .but if Petitioner Sponsor declares self unemployed , adds statement as to why she is not required to file taxes ( no earned income) , she should be cleared.

 

Additionally if brother/ Joint Sponsor is a W-2 employee AND his tax returns do NOT indicate other income ( like sch C if he has a side business) AND you submitted all the tax  return related forms ( mortgage interest paid, any minuscule interest earned on acts or investments) he too should be cleared.

Yes we submitted letter of unemployment for mom and she doesn't receive social security. And no schedule c or other source of income for uncle.

You have sent all documents for the joint sponsor

What about the petitioner? did you send an Affidavit of Support filled out by the petitioner?

The petitioner is still required to fill and AoS even if they don't have any income

11/17/2016: Got engaged
11/28/2016: I-130 sent to Chicago IL lock box
01/12/2016: NOA1

Yes submitted everything for petitioner otherwise they wouldn't even review my case.
